Inheritance by law

Calculator for distribution of inheritance under the law

Enter the already determined inheritance value and the composition of one class: living root heirs and branches inheriting by right of representation. For an inheritance case in Kyiv or Kyiv region, the calculator shows arithmetic only after the scope has been checked.

Shares within one inheritance order and representation branches

Each root share receives 1/N of the estate. If it is a representation branch, its 1/N is divided equally among the listed representatives.

Enter the amount after separately determining the estate, debts and the surviving spouse’s share. The calculator does not determine these.

Root shares in the order already established

One place represents one living heir or one branch of a deceased relative whose descendants are called to inherit by representation.

Root share 1

Root share 2

Enter only the persons actually called to inherit in place of one deceased root heir.

Confirm the narrow calculation scope

The result will be available only if all statements are true. If even one cannot be confirmed, the documents need analysis rather than automatic allocation.

Privacy: the calculation runs in your browser. The entered amounts and branch structure are not sent over the network unless you choose to send the result with an inquiry.

Confirm all scope limits. If an item is not confirmed, the heirs or shares cannot safely be determined by arithmetic alone.

How allocation by root places works

As a general rule, the statutory shares of heirs within the same order are equal. For inheritance by representation, first determine the share that would have belonged to the deceased relative, then divide that share equally among the descendants called to inherit.

The calculator does not select the order of succession or determine who has a right of representation. It applies the formula only to a structure already verified: living heirs in the root line plus confirmed branches by right of representation.

Methodology

Calculation methodology

Preliminary calculation methodology

  1. The user confirms that the order of succession, heirs, representation rights, and value for distribution have already been established, and that the complications listed in the calculator are absent.
  2. Each living root heir and each representation branch count as one root share.
  3. A unit is divided by the number of root places; the resulting fraction is the exact share for each place.
  4. For this branch, the exact share is also divided equally among the specified representatives and reduced to its simplest form.
  5. The value is multiplied by the exact fraction. Only the displayed monetary amounts are rounded to kopecks using the largest-remainder method so the total equals the entered value.
Example

Example: one son and a branch of a deceased daughter

The inheritance case already identifies two root branches: a living son and a daughter who died before the inheritance opened, whose two children inherit by right of representation. The value to be distributed is UAH 1,200,000.

  • Root shares: 2
  • Living root heirs: 1
  • One representation branch with two representatives
  • Inheritance value already determined: UAH 1,200,000

The living son receives an exact share of 1/2, approximately UAH 600,000. The branch share is also 1/2, so each of the two representatives receives 1/4, approximately UAH 300,000 each.

The example applies only if there is no will, compulsory share, change in order of succession, failure to accept, renunciation, disqualification, transmission, or dispute over kinship or estate composition.

Frequently asked questions

Frequently asked questions

What is a root place in this calculator?

This is a technical term for one position in the initial equal division: either a living heir in the established order, or the position of a deceased relative whose share passes to descendants by right of representation.

Why do representatives of a branch not receive an equal share alongside everyone else?

Because under the right of representation they jointly take the place of the deceased relative. First determine the share of that branch, then divide it equally among its members.

How does the right of representation differ from inheritance transmission?

The right of representation applies to descendants specified by law of a relative who died before the inheritance opened. Inheritance transmission arises when an heir dies after the inheritance has opened but before accepting it. The calculator does not model transmission.

Can the apartment value be entered as the entire estate value?

Only if it has already been confirmed that this specific value is subject to distribution. First determine separately the estate assets, debts, legal regime of the property, and any share belonging to the other spouse.

Why might amounts differ by one kopeck?

Some exact fractions cannot be represented as a whole number of kopecks. The tool preserves the legal share as a fraction and allocates indivisible kopecks in the monetary estimate so that the total matches the entered value.

Which notary should I contact in Kyiv or Kyiv Region?

The route depends on where the inheritance was opened, whether an inheritance case has already been opened, and current notarial procedure. Check whether a case is already open and contact a notary without assumptions about the address or a specific office.

Need to reconcile shares with the inheritance file?
