How to read the result
Article 288 of the Commercial Procedure Code sets a 20-day period for a cassation appeal. Whether it runs from pronouncement or preparation of the full text depends on what the appellate court announced and how it heard the case.
If the full decision was served later, filing within 20 days of service allows a request to restore the missed period. The court assesses the request; the calculator does not turn service into an automatic new deadline.
Calculation methodology
Identify the documented date of pronouncement, preparation of the full text or service.
Start counting on the next calendar day and add 20 calendar days.
If the preliminary last day is Saturday or Sunday, show the following Monday.
Mark separately when a service-based result concerns a request to restore the time limit.
Example
Example for a Kyiv region dispute
A company from Bila Tserkva checks a commercial appellate decision: only the operative part was read out at the hearing, and the full text was prepared later.
- Full text prepared on 12.10.2026
- Period: 20 calendar days
Day 20 is Sunday, 1 November; the indicative filing date is Monday, 2 November 2026.
Before filing, the company must verify the full-text date, cassation eligibility and payment documents.
Documents for review
- Full text of the first-instance decision and the commercial appellate court’s decision.
- Evidence of the date of pronouncement, preparation or service of the full text.
- Contract and appeal materials supporting a ground for cassation review.
- Court fee payment document, evidence of sending copies and proof of the representative’s authority.
Frequently asked questions
From which date should the 20 days be counted?
Usually from pronouncement of the commercial appellate court’s decision. If only the introductory and operative parts were read out, or the case was heard without summoning the parties, check when the full text was prepared.
I received the decision by post later. Do I have a new 20 days?
Filing within 20 days after service can support a request to restore the missed time limit. Restoration is not automatic; a motion and proof of service are needed.
Can every decision be challenged in cassation?
No. Article 287 of the Commercial Procedure Code defines which decisions and conditions permit cassation review. Before drafting, check the type of decision, claim value and statutory ground.
Why is the result moved to Monday?
The tool moves a Saturday or Sunday deadline under the general rule for procedural time limits. Check other non-working days, special rules and court hours separately.
