Severance pay

Severance pay calculator

Select the legal ground, enter the average monthly earnings already calculated by accounting and the current minimum wage. For a dismissal in Kyiv or Kyiv Region, the tool shows only the lower payment threshold: separately check the wording of the order and the original calculation under Procedure No. 100.

Preliminary calculation of the minimum payment

Enter amounts before tax deductions. The calculator works in kopecks, applies the selected guarantee under Article 44, and, if specified, the higher documented minimum.

1 × average monthly earnings. Only for paragraph 6 of Article 36, paragraphs 1, 2, or 6 of Article 40, or paragraph 6 of part one of Article 41 of the Labour Code.

Use the final amount from the employer’s calculation under Procedure No. 100. This is not a salary or an arbitrary average of recent payments.

By default — UAH 8,647, set as of January 1, 2026. If calculating for another date, enter the amount applicable on that date.

Enter only the total guarantee amount confirmed by a current document. A lower amount does not reduce the statutory minimum.

Formula: 30 000,00 UAH × 1 = 30 000,00 UAH

Important: The result is a gross reference. The calculator does not establish the grounds for dismissal, calculate average earnings under Procedure No. 100, or determine taxes, final settlement, or other amounts due.

How to read the minimum guarantee under Article 44

Article 44 of the Labour Code ties severance to the specific legal ground for termination, not the parties’ preference. First check the Code, clause, and wording of the order; then apply the multiplier.

For the one-, three-, and six-month branches, the calculator uses the ready-made average monthly earnings figure. Its components and calculation period are governed by Procedure No. 100; the tool deliberately does not reproduce an accounting calculation without source data.

For paragraph 3 of Article 36, use twice the current minimum wage. A higher contractual minimum entered here serves only as an arithmetic threshold and must be supported by a document.

Methodology

Calculation methodology

Preliminary calculation methodology

  1. The user selects one of the four minimum guarantee categories expressly listed in Article 44 of the Labour Code.
  2. For wage-related branches, enter the ready-made average monthly gross earnings under Procedure No. 100; for the military branch, enter the current minimum wage.
  3. The calculator multiplies the relevant amount by 1, 2, 3, or 6 without intermediate floating-point arithmetic.
  4. If a higher documentary minimum is entered, the result is the greater of the two amounts; a lower contractual amount does not reduce the statutory guarantee.
  5. The statutory minimum, contractual limit and source of the applied result are shown separately.
Example

Example of staff redundancy

An employee is being dismissed in Kyiv under paragraph 1 of Article 40 of the Labour Code. Accounting determined average monthly gross earnings of UAH 30,000 under Procedure No. 100.

  • Ground: paragraph 1 of Article 40 of the Labour Code
  • Average monthly earnings: UAH 30,000
  • Minimum wage: UAH 8,647
  • Higher contractual minimum: not set

The minimum severance payment under Article 44 is approximately UAH 30,000 gross.

The example does not confirm that the redundancy was lawful or that the accounting average is correct; other dismissal payments are calculated separately.

Frequently asked questions

Frequently asked questions

Is my average monthly wage equal to my salary?

Not necessarily. For severance pay, average earnings are determined under Procedure No. 100 using the proper calculation period and payments. It is best to obtain the payroll department’s calculation and check it.

Why does the calculator show an amount before taxes?

Article 44 calculates severance using wage figures. The actual take-home amount depends on current tax and deduction rules, which this tool does not model.

When do two minimum wages apply?

Only for termination of an agreement under paragraph 3 of Article 36 due to conscription or entry into military service, or assignment to alternative service. Similar life circumstances do not replace the specific legal ground.

Is one average monthly wage always paid upon redundancy?

Paragraph 1 of Article 40 falls under the branch providing at least one average monthly salary. However, check the exact ground in the order, the correctness of the average earnings, and any higher contractual guarantee.

Can a collective agreement provide for greater assistance?

Yes, if the relevant guarantee is in force and applies to the employee and ground for dismissal. For employer violations, Article 44 expressly refers to the contractual amount but sets a minimum of three average salaries.

Is compensation for unused leave included in the result?

No. Severance pay, wages through the dismissal date, unused leave compensation, and other amounts due are checked separately.

  • the calculator result can serve as a reference for a conversation
