How to File an Appeal in an Administrative Case
An appeal can be lost because the wrong starting date was used, a shorter special deadline applies, or the filing went to the wrong court. This guide helps distinguish the general deadline from renewal, check whether an order is appealable, and assemble the filing package.

What you should know
- The general deadline is 30 days for a judgment and 15 days for an order that may be appealed separately; the period starts the next day.
- If only the introductory and operative parts are pronounced, or the case is considered in writing, the period runs from preparation of the full text.
- Late service does not restart the general period: file within the 30/15-day window together with a renewal request and proof of service.
- File the appeal directly with the administrative court of appeal; for ordinary cases from local courts in Kyiv and the oblast, the usual route is the Sixth Administrative Court of Appeal.
- Urgent Chapter 11 CAPU cases and orders outside Article 294 require a separate check, not a general template.
When this is needed
Use this guide when a court of first instance has issued a judgment in an administrative case or made an order that the Code of Administrative Procedure of Ukraine (CAPU) allows to be appealed separately. The goal is not merely to disagree, but to file a proper appeal on time with specific requests to the appellate court.
First distinguish administrative proceedings from proceedings under the Code of Ukraine on Administrative Offences (CUAO), and from civil or commercial cases. A ruling on an administrative offence follows a different route. Do not apply the general 30- or 15-day periods to election cases or other urgent cases under Chapter 11 of the CAPU either: a special rule may leave much less time.
For an order, find the exact provision in Article 294 of the CAPU. If a separate appeal is not allowed, objections to the order are usually included in an appeal against the judgment; a separate appeal may fail the procedural admissibility check.
Applicable time limit and procedure
Article 295 of the CAPU sets the general time limits: 30 days for a judgment and 15 days for an order. The period starts on the day after the relevant event. If the full court act is pronounced at a hearing, the starting event is its pronouncement. If only the introductory and operative parts are announced, or the case is considered in writing, the starting event is the date the full text is prepared.
Administrative appeal deadline calculator deliberately shows two calendars. The first is the unchanged general deadline. The second applies when a copy is served later: 30 days after service of a judgment or 15 days after service of an order to file the appeal together with a request to renew the time limit. The second calendar does not cancel the first or guarantee renewal.
Service dates have their own rules under Article 251 of the CAPU. In particular, a document sent to an electronic cabinet after 17:00 is deemed served on the next working day, regardless of when the notification arrives. For postal service, a receipt, or another method, the case file needs corresponding proof.
If the last day falls on a weekend, public holiday, or another non-working day, the period ends on the first working day that follows. An automatic calendar can reliably move an ordinary Saturday or Sunday, but a special court schedule or another confirmed non-working day should be checked separately. Martial law by itself does not renew a procedural deadline.
For a prosecutor or a public authority, Article 299 sets a separate strict bar: after one year from preparation of the full text of the court judgment, appellate proceedings will not be opened regardless of the reason for delay. A narrow exception applies to an authority that was not notified of or involved in the case where the judgment decided a question concerning its rights or duties. This special one-year bar does not apply to a private party.
Step-by-step
Obtain the full text of the act and compare three dates: pronouncement, preparation of the full text, and service. Check the hearing record, judgment, electronic-cabinet receipt, envelope, or notice. Do not choose the latest date merely because it is more convenient.
Identify the case category and whether an appeal is allowed. For an order, find the relevant provision of Article 294. For an urgent case, find the special rule in Chapter 11. Then identify the proper appellate court. Under Article 297, the appeal is filed directly with that court, not through the registry of the court of first instance.
For ordinary administrative cases heard by local administrative courts in Kyiv and Kyiv Oblast, the usual appellate route is the Sixth Administrative Court of Appeal. This is not universal for every authority or case category: the court of first instance and special jurisdiction rules control. Before filing, verify the court name, address, and electronic filing details on its official website.
Build the appeal around errors in the judgment: which findings do not match the facts, which evidence was assessed incorrectly, which rule of substantive or procedural law was breached, and what decision the appellate court should make. Attach the court act, evidence, proof of court-fee payment or exemption, documents confirming the representative’s authority, and other required enclosures under Article 296 of the CAPU.
If the general time limit may have expired, file the appeal with a request to renew it. State separately the starting date of the general period, the actual service date, the delivery method, the reasons for delay, and the supporting evidence. Do not rely on a generic request to “renew for good cause.”
What to check before filing
Make sure the relief requested falls within the appellate court’s powers and that the grounds concern the scope of review. Check the case number, all parties, electronic-cabinet details, signature, authority to act, list of enclosures, and court fee. Check each file and keep the delivery receipt.
If filing on the last day, leave a technical buffer. An electronic-cabinet outage, qualified-signature error, or incomplete upload does not establish successful filing. For post, keep the receipt and inventory of enclosures; for in-person filing, keep a stamped copy; for the electronic court system, save every system receipt.
Separately check whether a special time limit applies, whether the order can be appealed, whether service after 17:00 was dated correctly, and whether the one-year bar applies to the appellant. Adding 30 or 15 days alone does not resolve these issues.
When to consult a lawyer
Legal review is particularly useful if the general period has expired, the full text arrived late, an electronic-cabinet delivery took place in the evening, it is unclear whether the order is listed in Article 294, the case may be urgent, or the proper appellate court is uncertain.

What to prepare
- The full text of the judgment or order, showing its preparation date and case number.
- The hearing record or other material confirming what was pronounced.
- Electronic-cabinet receipt, postal envelope, tracking record, notice, or acknowledgment of service.
- An appeal naming the appellate court and setting out party details, requested relief, grounds, and enclosures.
- Proof of court-fee payment or confirmation of an exemption, deferral, installment plan, or waiver.
- Documents confirming the representative’s authority and proof that copies were sent to other parties, where required.
- A renewal request with a timeline and supporting evidence if the general period may have expired.
Common mistakes
- Counting from receipt of a copy as if late service automatically replaced the pronouncement or full-text preparation date.
- Applying 30 or 15 days to an urgent Chapter 11 CAPU category with a special deadline.
- Appealing an order separately without finding it in the list in Article 294 of the CAPU.
- Ignoring that a document sent to an electronic cabinet after 17:00 is deemed served on the next working day.
- Filing through the court of first instance even though Article 297 requires filing directly with the appellate court.
- Requesting renewal in general terms without proof of service and an explanation of the whole delay.
- Assuming martial law automatically suspended or renewed the procedural deadline.

Frequently asked questions
How many days do I have to appeal an administrative case?
Under the general rule in Article 295 of the CAPU, there are 30 days for a judgment and 15 days for an order. Urgent categories and other special cases may have shorter periods, so identify the applicable procedure first.
What date starts the deadline?
The day after the full court act is pronounced. If only the introductory and operative parts are announced, or the case is considered in writing, it is the day after the full text is prepared.
What if I received the full judgment later?
Do not replace the general deadline with the receipt date. File within 30 days after service of a judgment or 15 days after service of an order, request renewal at the same time, and attach proof of service. The court makes the final decision on renewal.
How is service through an electronic cabinet after 17:00 counted?
Under Article 251 of the CAPU, a document sent to an electronic cabinet after 17:00 is deemed served on the next working day. Save the system confirmation showing the delivery date and time.
Which court should receive an appeal in Kyiv?
Article 297 of the CAPU requires filing directly with the appellate court. For an ordinary case from a local administrative court in Kyiv or Kyiv Oblast, the usual court is Sixth Administrative Court of Appeal; check the court of first instance, subject matter, and any special exceptions.
Does the one-year bar apply to an ordinary person or company?
The special one-year bar in Article 299 applies to prosecutors and public authorities. It does not apply to a private party, although the court still assesses the reasons for delay and the evidence.
