Deadline to file in an administrative court

Administrative court filing deadline calculator

The tool helps residents of Kyiv and Kyiv Oblast check the typical time limit for challenging a decision, action, or inaction by a public authority. It does not assume the general six-month period where the law may set a special deadline, jurisdiction is uncertain, or the triggering event is unknown.

Check the route and calendar date

Select the rule under Article 122 of the Code of Administrative Procedure, enter the confirmed base date and complete the three safeguards.

Which rule are you checking?

Applies only when the Code of Administrative Procedure of Ukraine or another law does not set a special period.

Enter a confirmed event: service of the decision, access to the case materials or another date that can be proved.

Required checks before calculation

If even one item is not substantiated, the tool deliberately does not show a final date.

How the calculation works under the Code of Administrative Procedure of Ukraine

Article 122 of the Code of Administrative Procedure of Ukraine sets a general six-month period from when a person learned or should have learned of the violation. After a timely pre-trial appeal, the period is three months from service of the decision; if no decision was made or served on time, it is six months from filing the complaint. Disputes about entry into, service in, or dismissal from public service have a one-month period.

Articles 120–121 govern calendar calculation and renewal. Martial law does not automatically suspend procedural deadlines: the court assesses the reasons for delay and the evidence. The claim must also comply with Articles 160–161 of the Code of Administrative Procedure of Ukraine.

Preliminary review methodology

  1. One of the four routes under Article 122 of the Code of Administrative Procedure of Ukraine is identified.
  2. The user separately confirms that no special deadline applies, that the matter falls within administrative jurisdiction, and that there is evidence of the base date.
  3. The period starts on the day after the triggering event; add 6, 3, or 1 calendar month.
  4. For a shorter month, use its last day; if that day is Saturday or Sunday, move it to Monday.
  5. The result shows the calendar, current status, and caveats about martial law and special rules.
Example

Example of the general time limit

A Kyiv resident received an individual decision from a city authority on February 4, 2026. Jurisdiction and the absence of a special deadline have been preliminarily checked.

  • Route: general six-month period
  • Base date: 04.02.2026
  • Start of the period: 05.02.2026

Preliminary final day — August 4, 2026. Submit the documents with proof of the time and method of filing.

The example does not apply if a special deadline governs the subject matter or the authority acted outside public-law relations.

Documents

What to prepare before filing

  • A decision, letter, demand, or evidence of a public authority’s inaction.
  • Proof of service or awareness: envelope, tracking details, electronic notice, receipt, or extract.
  • The pre-trial complaint, proof it was filed, and the decision on it, if this route was used.
  • Documents proving the violated right, the representative’s authority, and court-fee payment or an exemption.
  • Claim under Articles 160–161 of the Code of Administrative Procedure of Ukraine, copies, and proof of service on the participants.
  • An application to renew the deadline with supporting evidence, if the estimated date has passed.

Frequently asked questions

Frequently asked questions

Does the six-month period always apply?

No. The Code of Administrative Court Procedure of Ukraine and other laws set special time limits. For public service, the typical period is one month, or three months from service of a timely pre-trial decision.

From the date of the decision or the date it was received?

This depends on the procedural route and the specific rule. The general rule is tied to when the person learned or should have learned; for a timely pre-trial decision, the law expressly uses service.

Does martial law suspend the time limit?

Automatically — no. Specific wartime circumstances may support reinstatement, but they must be described and proved; the court makes the decision.

What happens if filing is late?

Under Articles 121–123 of the Code of Administrative Procedure of Ukraine, the party must request renewal of the time limit and state valid reasons. Without a proper application or where the reasons are invalid, depending on the stage, the claim may be left without movement, returned, or left without consideration.

Is it enough to send the claim on the final day?

The period is not missed if documents are submitted to the post office or sent by another proper means of communication before 24:00. Keep the receipt, enclosure list, e-court receipt, or other confirmation.

Need to check the deadline and route to the administrative court?

Submit an application if you need to check a decision by a Kyiv authority, when it was received, the special rule, jurisdiction, and the package for an administrative claim.

  • the calculator result can serve as a reference for a conversation
  • documents, deadlines, or contract terms may change the conclusion
  • briefly describe the circumstances in the form if needed
