How to file a cassation appeal in a civil case
A cassation appeal in a civil case is not a third hearing of the dispute from scratch. For a Kyiv case, promptly check the 30-day deadline, whether cassation is available, the grounds for review, proof of when the decision was received and the complete set of attachments.

What you should know
- A cassation appeal is usually due within 30 days, but the start date depends on pronouncement, the full text and service.
- Before drafting, check whether cassation is allowed for your case category.
- The appeal must show statutory CPC grounds for cassation review, not merely disagreement with the outcome.
- The filing package includes the court fee, proof of sending copies, representative authority and proof of the decision receipt date.
- If the deadline was missed, prepare a separate restoration request with evidence of valid reasons.
When this is needed
This guide is for a party considering cassation after the appellate court has issued a ruling or separate order. Cassation does not repeat an appeal: the Supreme Court does not gather facts again where the complaint only disagrees with the assessment of evidence.
For Kyiv cases, the practical first step is a short audit, not a long draft: is cassation available, when does the period expire, what is the key legal error, is the full decision available and is its receipt date documented? If the appeal stage is still underway, first check the appeal deadline and the appeal materials.
Applicable time limit or procedure
The general period for filing a cassation appeal in a civil case is 30 days. A procedural period usually starts on the day after the relevant procedural event. If its final day falls on a weekend, the rules shift it to a working day.
The main risk is choosing the wrong start date. Depending on the case, it may be the date of pronouncement, preparation of the full text or service of the decision on a participant. For an initial calendar estimate, use the cassation deadline calculator, but confirm the date with documents before filing.
Steps to take
First obtain the full text of the appellate ruling and the first-instance judgment. Without the full text, it is not possible to properly assess cassation grounds, the court fee, appeal requirements or the scope of review.
Next determine whether cassation is allowed. Check the case category, claim value, minor-case status, subject matter and procedural filters. For a debt case, separately assess the calculation, limitation period, evidence and possible consequences for enforcing the judgment.
Then state the cassation grounds. Explain exactly how the courts misapplied substantive or procedural law. Repeating the appeal without cassation grounds is usually insufficient. If you are considering an application to Strasbourg after national proceedings, separately check which decision starts the ECHR application period: filing cassation does not always mean it is the effective final remedy for every complaint.
The final step is the filing package: court fee, proof that copies were sent to other participants, representative authority documents, proof of the decision’s service date and, if needed, a request to restore the deadline.
What to check before filing
Check that the appeal does not combine different procedural issues. If the problem is that the defendant did not file a response or evidence in the first instance, first assess whether cassation can address it. If the issue arose before judgment, the separate guide to a response to a claim or an appeal-stage review may help.
Check the court fee and filing method separately. Electronic filing may have technical requirements; an incorrect payment or missing proof that copies were sent can result in the appeal being left without movement. If you overpaid or cassation ends through a procedural act, check whether the court fee can be refunded.
When to consult a lawyer
A lawyer is useful when the deadline is near, the claim value is high, cassation may be inadmissible or earlier filings were left without movement. The common mistake is not a missing document but the wrong focus: arguing facts that the cassation court will not reweigh instead of identifying a legal error.
For a Kyiv case, advice can help quickly reject a weak route, identify the actual deadline, prepare a restoration request and assemble a package that is less likely to be returned for technical defects.
What to prepare
- Appellate court ruling, first-instance judgment and any rulings affecting the subject of cassation.
- Proof of when the full text was prepared or served: postal notice, electronic account, receipt or case-file records.
- Appeal materials, party submissions, hearing records and evidence cited in the cassation appeal.
- Court fee receipt or documents seeking exemption, deferral or reduction.
- Proof that copies were sent to participants and documents confirming the lawyer’s or other representative’s authority.
Common mistakes
- Counting 30 days from an unverified date without confirming pronouncement, the full text or service.
- Writing cassation as a repeat appeal without stating specific cassation grounds.
- Failing to check whether the case is minor, its claim value, category or other limits on cassation access.
- Adding new evidence without understanding the limits of cassation review.
- Omitting proof that the appeal was sent to other participants or proof of representative authority.

Frequently asked questions
Can I file cassation without a lawyer?
In many civil cases, representation in cassation requires a lawyer, but exceptions apply. Before filing, check the party’s status, case category and representation rules.
Is the deadline always 30 days?
The general period under the CPC is 30 days, but the start date matters. If the full text was served later, you may need to request restoration and prove when it was served.
Can I add new evidence to cassation?
The cassation court usually reviews the application of law rather than establishing facts again. New evidence does not replace proper cassation grounds and should be treated cautiously.
What if my cassation appeal is left without movement?
Meet the court order’s requirements within the stated period: pay the balance of the fee, correct attachments, provide copies or fix other deficiencies. Calculate that cure period separately.
