Newly discovered circumstances

Deadline calculator for review based on newly discovered circumstances

Select the event from which the 30 days run in your case: when you learned of the material circumstance, when the conviction entered into force, or when the underlying decision was cancelled. For a Kyiv case, the calculator gives a calendar guideline but does not determine whether a newly discovered circumstance exists.

The calculator does not determine whether a circumstance is newly discovered or calculate the 3-year or 10-year long-stop period from the date the decision became final.

The brief summary is easy to paste into a message to a lawyer or save for yourself.

What the calculator takes into account

The Civil Procedure Code provides a 30-day period to apply for review of a court decision based on newly discovered circumstances. The start date depends on the ground: a material circumstance, a criminal conviction or ruling, or cancellation of the decision that served as the basis.

Separate outer limits run from the date the decision enters into force: 3 years for material circumstances and 10 years for other grounds and exceptional circumstances. These limits generally cannot be renewed, so check them before preparing an application.

Methodology

Calculation methodology

Deadline calculation methodology

  1. The user selects the grounds and triggering event for the 30-day period.
  2. The user enters the date of this event according to the documents.
  3. The calculator starts counting on the next calendar day.
  4. The last day moves from Saturday or Sunday to Monday.
Example

Calculation example

A party to a civil case in Kyiv learned of a material circumstance on June 5, 2026.

  • Scenario: material circumstance
  • Start date: 05.06.2026
  • Period: 30 calendar days

Estimated last day to file the application: July 6, 2026, because July 5 falls on a Sunday.

Separately check whether the 3-year outer limit from the date the decision entered into force has expired.

Frequently asked questions

Frequently asked questions

What is a newly discovered circumstance?

This is a material circumstance for the case that existed when it was considered but was not and could not have been known to the applicant. A new document or disagreement with the assessment of evidence will not always qualify.

Why does the calculator not calculate 3 or 10 years?

This requires the date the decision became final and the precise ground for review. Without these details, an automated conclusion may be unsafe.

Where to file the application?

It depends on which decision is being reviewed and the grounds for the application. Filing rules are usually set out in Article 425 of the Civil Procedure Code.

Can an application be filed after cassation?

Yes, but this is not a substitute for cassation or a rehearing of all arguments. You must establish the specific ground for review based on newly discovered circumstances and meet the time limits.

Need to check the grounds for review?

Submit an application if you need to check the 30-day period, the outer limit, evidence, and the court for filing an application in a Kyiv case.

  • the calculator result can serve as a reference for a conversation
  • documents, deadlines, or contract terms may change the conclusion
  • briefly describe the circumstances in the form if needed
