How to terminate a residential lease and properly return the apartment

Moving out of an apartment alone is not enough to safely end a private residential lease. This guide helps tenants in Kyiv and Kyiv region review the agreement, deliver written notice, wait out the required period, and document the return of the home.

What you should know

  • For an ordinary private lease, the tenant gives the landlord three calendar months’ written notice and obtains the consent of people who permanently live with the tenant.
  • It is safer to count the period from confirmed receipt of the notice, not from the date it was written or sent.
  • The agreement, condition of the home, keys, meters, payments, and return of the security payment should be closed out in a separate report and reconciliation.
  • Special situations — an uninhabitable home, mutual agreement, public housing, lease with purchase, or landlord-initiated termination — require a different route.

When this guide is relevant

This guide covers a tenant who plans to terminate an ordinary private apartment or house lease. It helps avoid leaving the landlord with only an oral promise to move out and losing evidence of the date from which the notice period is counted.

First, distinguish special cases. For public or municipal housing, a lease with purchase, termination initiated by the landlord, or a home that has become unfit for permanent residence, the ordinary three-month process may not fit the legal grounds. If the landlord and tenant have already agreed on an earlier move-out, record it in writing together with the settlement.

For an apartment in Kyiv, check the landlord’s identity as well as the address. The notice must be received by a party to the agreement or a duly authorised representative. A concierge, real-estate agent, or the landlord’s relative does not always establish legally effective delivery.

What period or procedure applies

Part 1 of Article 825 of the Civil Code of Ukraine allows a tenant to withdraw from a residential lease at any time with the consent of other people who permanently live with them. The landlord must receive three months’ written notice.

For the timeline, you need a confirmed receipt date. Under Articles 253–255 of the Civil Code of Ukraine, the period begins the following day. A period stated in months ends on the corresponding date in the final month; if that date does not exist, it ends on the last day of the month. Use the three-month notice calculator to see the nominal end date, a cautious adjustment for a weekend, and the move-out date after the full period separately.

If the tenant leaves without notice, the landlord does not automatically become entitled to three months’ rent solely because the tenant moved out. Article 825 ties the claim to proof that the landlord could not lease the home to another person on the same terms. Consider the actual circumstances, correspondence, attempts to rent the home again, and the agreement’s terms.

How to proceed step by step

Start with the agreement. Check the landlord’s name or legal entity, the home’s address, the lease term, how notices are exchanged, early termination terms, the security payment, utilities, and the return report. If different clauses set different periods, do not choose the more convenient one at random.

Prepare a separate written notice. Identify the parties, agreement details, exact address, your intention to end the lease, and the planned end date. Obtain consent from people who permanently live with you in a form that can be proven. Do not include unverified accusations if the notice’s main purpose is to clearly record your decision.

Deliver the document in a way that proves both its text and the date of receipt. For personal delivery, ask the recipient to write their name, date, and signature on the second copy. For postal delivery, keep the receipt, inventory of contents, tracking record, and delivery confirmation. If the agreement recognises electronic notice, preserve the full message thread and information identifying the proper recipient.

Before moving out, propose an inspection in writing. Record the rooms, furniture and appliances, existing defects, meter readings, number of keys, actual return date, and final amounts in the report. For a Kyiv apartment, dated photos and a detailed report are especially useful when the landlord lives in another city and accepts the home through a representative.

What to check before sending the notice

Make sure the notice is addressed to a party to the agreement. If there are several owners or an agent signed the agreement, check who is authorised to receive the withdrawal notice. Compare the address in the agreement with the actual home and the registration documents shown when you moved in.

Keep termination of the agreement separate from a financial dispute. Rent, utilities, repairs, the security payment, and damage compensation require different evidence. If the landlord calls a payment a “deposit”, check its actual function and the written clause; a useful next step may be the guide on how to recover a contractual deposit.

Before handing over the keys, photograph every room, appliance, and meter. Hand over the keys against a dated signature. If the landlord avoids the inspection, propose several specific dates in writing and do not leave the keys with an unverified person without considering the consequences.

When to consult a lawyer

A lawyer can help if the agreement sets another notice period or conflicting notice methods, the landlord does not receive the letter, objects to an early move-out, or threatens to automatically keep all payments. An uninhabitable home, an emergency, serious defects, multiple owners, subletting, or a dispute about consent from permanent residents also needs separate assessment.

For a home in Kyiv or Kyiv region, bring the agreement, the notice itself, proof of delivery, correspondence, payment history, and photos of the apartment’s condition to the consultation. These materials help separate the termination timeline from a money dispute and prepare a report that does not hide unresolved claims behind a statement that there are no claims at all.

Documents

What to prepare

  • The lease agreement and all addenda, inventories, and reports signed when the tenant moved in.
  • Written notice stating the home’s address, referring to the agreement, giving the planned end date, and signed by the tenant.
  • Evidence of the notice’s contents and receipt: a signed copy or postal records with an inventory of contents and tracking.
  • Consent from people who permanently live with the tenant, in a form that can be proven later.
  • Photos and video of the apartment’s condition, a list of furniture and appliances, meter readings, and the set of keys.
  • Receipts for rent, utilities, the security payment, and agreed repair expenses.
  • A draft report returning the home and reconciling the parties’ accounts, listing any unresolved amounts.
Risks

Common mistakes

  • Counting three months from the letter’s date without proof of when the landlord received it.
  • Giving notice only orally or in a short message without preserving its contents, addressee, and delivery confirmation.
  • Ignoring the consent of people who permanently live with the tenant, even though Article 825 of the Civil Code of Ukraine expressly refers to it.
  • Returning the keys without a report, photos, meter readings, and a record of the property’s condition.
  • Automatically agreeing to pay three additional months of rent without checking the agreement and evidence that the home could not be rented again.

Frequently asked questions

Frequently asked questions

Can a tenant terminate the agreement at any time?

For an ordinary private lease, Article 825 of the Civil Code of Ukraine allows a tenant to withdraw from the agreement at any time with the consent of people who permanently live with them and after giving the landlord three months’ written notice. Special types of housing and grounds must be checked separately.

When do the three months’ notice begin?

In practice, it is safer to tie the timeline to proven receipt of the notice by the landlord. As a general rule, the period begins the following day, and three calendar months end on the corresponding date.

Can the parties agree on an earlier move-out date?

Yes. The parties may agree in writing on an earlier date, the handover of keys, final payments, and return of the security payment. This is a separate agreed arrangement, not an automatic shortening of the unilateral notice period.

Is sending notice in a messaging app enough?

Check the agreement’s notice clause, whether the parties can be identified, whether the complete text is available, and whether receipt can be proven. A signed copy or postal delivery with an inventory and delivery confirmation is often more reliable in a dispute.

Must the tenant automatically pay three months’ rent if they move out without notice?

No. This is not an unconditional automatic payment. Under Article 825, the landlord must prove that because the tenant left without notice, the landlord could not enter into a lease on the same terms with another person.

How should the apartment and keys be returned?

Sign a bilateral report stating the date, condition of the premises and property, meter readings, number of keys, and final payments. Attach photos and keep proof that a copy was given to the landlord.
