Penalty for overdue child support
Penalty calculator for late child-support payments
Select the basis for child support, add the full sequence of monthly accruals and all payments by date. The calculator allocates funds to the oldest debt, excludes the payment date for the amount paid off and shows the preliminary penalty as of the end of the selected day. For cases in Kyiv and Kyiv Region, check the result against the enforcement officer’s calculation and evidence of the payer’s fault.

Preliminary calculation of child-support penalty
Each monthly accrual is calculated over separate exact intervals, payments are allocated FIFO, and the 100% cap is applied once to the aggregate base.
This determines whether the enforcement officer’s penalty is taken into account: Article 196 of the Family Code deducts it from the alimony penalty cap only for court-awarded alimony.
Enter the complete chronological sequence of months needed for FIFO, without duplicates. For a standard monthly payment, delay starts on the first day of the following month.
Add all payments that can be identified as child support. Funds first pay off the oldest debt, then the accrual for the payment month; future months are not paid automatically.
The payment date is excluded from the penalty days for the amount paid.

Estimated result
Preliminary calculationAggregate formula: min(1 475,00 UAH; max(0; 4 000,00 UAH − 0,00 UAH)) = 1 475,00 UAH
Amounts are stored in kopecks. The 1% is calculated as the exact fraction 1/100 without daily rounding; one total is rounded to the nearest kopeck using half-up rounding.
Main caveat: The penalty depends on the payer’s fault; the court may reduce it based on the payer’s financial and family circumstances, and the enforcement officer determines the official alimony arrears, or the court does so in a dispute. Therefore, the arithmetic does not guarantee the amount recovered.

How the calculator calculates child support penalties
Under Article 196 of the Family Code of Ukraine, the recipient of child support may claim a penalty of 1% of the unpaid amount for each day of delay. For a standard monthly payment, calculation for a particular month starts on the first day of the following month.
A partial payment does not cancel the penalty already accrued. It first pays the oldest entered arrears, then the accrual for the payment month. Future months are not paid automatically. The payment date is excluded only for the amount repaid; the unpaid balance continues accruing a penalty from that date.
The calculator totals the exact penalty for all intervals and compares it once with the aggregate portion of accrued amounts that was overdue for at least one day. Payments made before the delay began reduce this base. For child support awarded by a court, the base is further reduced by the entered enforcement officer’s fine; no fine applies to a contract.
Calculation methodology
Step-by-step calculation methodology
- Sort monthly accruals from oldest to newest and set the first day of the following month as the standard start of arrears for each.
- Sort payments by date and allocate each FIFO: first to the oldest unpaid month, then through the payment month, but not to future months.
- For each part of the debt, count all calendar days: exclude the payment date for the amount paid, and include the end date for the balance as of the end of that day.
- Add the exact products “balance × days × 1/100” without daily or monthly rounding.
- We build the aggregate base only from installments that were overdue by at least one day, apply the 100% limit once, and reduce it by the permissible penalty for court-awarded child support.
- We compare the exact penalty with the cap and only then round the final amount to the nearest kopeck.
Example with two partial payments
UAH 5,000 was due for January. UAH 1,000 was paid on January 31 and another UAH 1,500 on February 11. The calculation for preparing documents in Kyiv is made as of the end of February 20.
- Monthly accrual for January: UAH 5,000
- Payment on 31 January: UAH 1,000 — before the delay began
- Payment on 11 February: UAH 1,500
- End date: February 20 inclusive for the remaining balance
A pre-default payment reduces the 100% base to UAH 4,000. From 1 to 10 February: UAH 4,000 × 1% × 10 days = UAH 400. From 11 to 20 February: UAH 2,500 × 1% × 10 days = UAH 250. The uncapped penalty and preliminary result are UAH 650; the remaining debt is UAH 2,500.
The example shows arithmetic only. The court separately assesses fault and may reduce the penalty; check the debt amount against the enforcement officer’s calculation.
What to prepare to check the calculation
- Court decision, court order, writ of execution, or child-support agreement stating the amount and payment schedule.
- Official monthly calculation of debt by a state or private enforcement officer.
- Bank statements, receipts, acknowledgments and payment descriptions showing the date and connection to child support.
- The enforcement officer’s fine order and the exact fine amount, if child support was awarded by a court and the fine must be deducted from the penalty cap.
- Documents about the payer’s fault or lack of fault and their financial and family circumstances.
- The selected claim period and the date through which the penalty is claimed, especially if the debt was still unpaid then.

Frequently asked questions about child-support penalties
From what date does a penalty accrue on monthly child support?
For a standard monthly payment, the period starts on the first day of the month after the month for which child support was due. If the decision or agreement sets another specific date, check the method separately.
How are partial child support payments accounted for?
A payment is applied to the oldest entered arrears. The payment date is not counted for the portion paid off, while the penalty continues to accrue on the remaining balance, including the day of a partial payment.
Can the penalty exceed the debt amount?
The total penalty is capped at 100% of the debt on which it accrues. In aggregate, the calculator includes only portions of monthly accruals that were at least one day overdue; amounts paid on time do not increase the base.
Why enter a fine imposed by a state or private enforcement officer?
Article 196 of the Family Code allows this reduction only for child support awarded by a court. Select a court decision or court order and enter the exact amount from the ruling for the same debt. The field is disabled for a contract.
Will the court award the amount shown by the calculator?
Not necessarily. The court checks fault, the accuracy of the debt and payments, and may reduce the penalty based on the payer’s financial or family circumstances. The result is an arithmetic aid, not a prediction of the decision.
What does an excess payment in the result mean?
This is the part of payments that could not be allocated to old debt or accruals for the payment month. It does not create a negative debt or automatically pay future months; check missed periods, the payment reference, or a separately documented advance.
