Calculatorpreliminary calculation
5% court-fee threshold
Calculator for the 5% annual-income court fee threshold
Enter the court fee set for your document and all documented income for the previous calendar year. The calculator compares the amounts to help prepare a motion in a case in Kyiv or Kyiv Region, but does not determine eligibility for exemption, reduction, deferral or payment by instalments.

Compare the fee with 5% of annual income
The threshold equals income for the previous calendar year × 5%. The condition is met only when the fee is strictly greater than the threshold, not equal to it.
Enter the already calculated full fee for a claim, application, or complaint before any possible court relief under Article 8.
Add all documented income for the calendar year immediately preceding the year you apply to court.

Comparison: The fee strictly exceeds the 5% annual-income numerical threshold
Important: This is only one numerical indicator under part one of Article 8. The court assesses financial circumstances and evidence and has discretion; the subject of the claim, the person’s status, benefits, and other legal grounds must be reviewed separately.

What exactly the calculator checks
Part one of Article 8 of the Law of Ukraine “On Court Fees” lists a fee exceeding 5% of an individual’s annual income for the previous calendar year as one condition under which the court may defer or allow installment payments, taking financial circumstances into account. Part two allows the fee to be reduced or waived on the same grounds.
The tool performs an arithmetic comparison only. It does not assess whether certificates are sufficient, family composition, assets, access to funds, claimant status, the subject of the claims, or a special exemption under Article 5.
First determine the applicable rate separately and check whether a fee is charged under Article 3 and whether an exemption under Article 5 applies. Do not enter a desired or already reduced amount instead of the full rate for the specific procedural document.
Calculation methodology
Review methodology
- We identify the full court fee F for the specific procedural document, without accounting for the requested relief.
- We collect total income I for the calendar year before the year of application, supported by documents.
- We convert both amounts to kopecks and calculate the exact threshold I × 5 / 100.
- For display, the threshold is rounded to the nearest kopeck using the half-up rule, but the inequality is checked before rounding.
- We show whether the strict condition F > T is met, without concluding that an exemption applies or predicting a future court decision.
- We separately remind you to check Articles 3, 5 and all alternative branches of Article 8 and attach evidence of financial circumstances.
Example of a motion in a Kyiv case
An individual is filing a procedural document in a Kyiv court in 2026. The assessed fee is UAH 15,000.01, and the confirmed total income for 2025 is UAH 300,000.
- Court fee F: UAH 15,000.01
- Annual income I: UAH 300,000
The threshold is 300,000 × 5% = UAH 15,000.00. The fee exceeds the threshold by UAH 0.01, so the numerical indicator is triggered.
A one-kopeck difference does not guarantee a court decision. The motion must include complete evidence of financial circumstances and explain the chosen form of relief.
What to prepare for a motion
- Calculation of the full court-fee rate for a specific claim, application, or complaint.
- Information from the State Register of Individuals — Taxpayers about income for the previous calendar year.
- Certificates of salary, pension, social benefits, business and other income for the same period.
- Bank statements and documents about savings, regular payments, dependants and significant expenses, if they explain the financial situation.
- Documents about family composition, disability, status, or the subject of the claim, if another branch of Article 8 is asserted.
- Draft reasoned motion with a clear request and list of attachments.

Frequently asked questions
Does exceeding 5% guarantee exemption from the court fee?
No. The formula shows only one statutory condition. The court considers financial circumstances, assesses the evidence, and decides whether to grant deferral, installments, a reduction, or an exemption.
What income should be entered?
The individual’s documented total income for the entire previous calendar year. If applying in 2026, the base period is 2025.
What happens if the fee is exactly 5% of income?
The calculator will show that the threshold has not been exceeded because the law says “exceeds 5 percent.” Other grounds under Article 8 and exemptions must still be checked separately.
Can zero income be entered?
Yes. The threshold will be UAH 0.00, so any positive fee will exceed it. However, zero income does not replace evidence of financial circumstances and does not guarantee a favorable decision.
Does the tool account for exemptions under Article 5?
No. First check whether a fee is payable under Article 3 and whether Article 5 or a special rule exempts the applicant. The 5% threshold is needed only for a specific branch under Article 8.
Will the calculator create an instalment schedule?
No. The law does not set a universal schedule for all cases. A motion may explain the requested relief, but the court determines the specific method and limits.
