Court fee refund

Court fee refund calculator

Enter the amount already paid, the ground, and the court level. For an overpayment or a reduction in the claim amount, enter the amount that should have been paid. The tool does not calculate the court fee itself; it determines only a possible refund from a specific payment.

Preliminary refund calculation

The calculation uses kopecks, rounds the share to the nearest kopeck, and cannot show a refund greater than the amount paid.

Enter the amount of one payment for a claim, application, appeal, or cassation appeal.

Select the wording that matches the ruling, judgment or procedural situation. The difference between the amount paid and the amount due is refunded.

Court instance

The instance determines which court to apply to and which specific payment to analyze. Payment for a claim, application, or complaint in the court of first instance.

For an overpayment or reduced claim, enter the correct fee after recalculation. The amount may be zero.

Estimated result

Preliminary calculation
Estimated refund500,00 UAH

Formula: max(0; 2 000,00 UAH − 1 500,00 UAH) = 500,00 UAH

Next step: Check whether the court act resolved the refund and verify the budget revenue classification code for the payment. Submit the application and the original or a copy of the payment instruction to the relevant court authority, which will prepare an electronic submission to the Treasury.

Important: This is not a court-fee rate calculator. The result is based on the amounts entered and the selected ground; eligibility for a refund and the contents of the motion must be checked against the court act and procedural law.

How the refund amount is determined

Article 7 of the Law of Ukraine “On Court Fees” distinguishes overpayments, grounds for a full refund, and cases where 50% or 60% of the fee is refunded. The same amount paid may therefore produce different results depending on the procedural ground.

The tool does not determine the fee rate based on the claim value or type of application. For an overpayment, the user enters the amount that should have been paid; for other branches, the calculator applies only the statutory fraction to the specific payment.

If an exception is selected or the basis is unclear, the calculator deliberately returns “review required” rather than an amount of UAH 0.

Methodology

Calculation methodology

Calculation methodology

  1. We record the amount paid under one specific payment document.
  2. Select the court instance and ground under Article 7 of the Law of Ukraine on Court Fees.
  3. For an overpayment or reduced claim, subtract the amount that should have been paid; where the full ground applies, use the entire amount paid.
  4. For a settlement, withdrawal, or admission of the claim, apply 50%; after mediation, apply 60%.
  5. We round to the nearest kopeck, cap the result at the amount paid, and show the legal branch and next procedural step.
Example

Example of an overpayment

The claimant in a case before a court in Kyiv paid UAH 2,000 in court fees, but after the claim was reduced, the proper amount is UAH 1,500.

  • Paid: UAH 2,000
  • Amount due: UAH 1,500
  • Ground: reduction of the claim
  • Instance: first

Estimated refund: UAH 500. Amount not refunded by this calculation: UAH 1,500.

The example assumes the correct court fee of UAH 1,500 has already been determined and confirmed by the case materials.

Frequently asked questions

Frequently asked questions

Does the tool calculate the court fee rate?

No. The calculator starts with the amount already paid. For an overpayment or reduction of claims, separately enter the amount that should have been paid.

When is only the overpayment refunded?

If the claims are reduced or the fee paid exceeds the amount established by law, the difference between the amount paid and the amount due is refunded.

Does leaving an application without consideration always result in a full refund?

No. Point 4 of part one of Article 7 contains exceptions, including certain cases of repeated non-appearance, failure to submit requested materials, or a motion by the claimant. If unsure, choose the review branch.

What is the difference between 50% and 60%?

The base share is 50% for a settlement, withdrawal of a claim, or admission of a claim. If the relevant agreement is reached as a result of mediation, the law provides for 60%.

Why select a court instance?

The calculation must be tied to a specific payment: for a first-instance claim, an appeal, or a cassation appeal. The court instance also determines which court receives the motion.

What to do after the preliminary calculation?

Check whether the court act resolved the refund and verify the budget revenue classification code for the payment. The application with all details and the original or a copy of the payment instruction must go to the relevant court, Supreme Court, High Anti-Corruption Court, or State Judicial Administration, not directly to the Treasury. That authority prepares an electronic submission to the Treasury.
