Default judgment

Default judgment set-aside deadline calculator

The calculator helps estimate the deadline for applying to set aside a default judgment under two rules: the general 30-day period and a 20-day reference from service of the full judgment when the deadline was missed. For cases in Kyiv and Kyiv Oblast, be sure to check the calculation against the procedural documents.

Preliminary calculation under Article 284 of the Civil Procedure Code

Select the relevant scenario and event date. The tool shows an estimated final deadline and moves Saturday/Sunday to Monday.

Select a scenario

Baseline rule: an application to review a default judgment must be filed within 30 days of its pronouncement.

For the 30-day scenario, use the date of pronouncement; for the 20-day scenario, use the date the full default judgment was served.

Estimated time limit

the period is estimated to still be running
Estimated deadline to file the application: 23 November 2026

Method: 23 October 2026 + 30 days = 23 November 2026

Deadline status: the period is estimated to still be running: in 31 days

the last day was moved from a weekend to Monday

Caution: The 20-day scenario is only a reference for applying for restoration. Restoration is not automatic and depends on the court’s assessment.

How to read the result

Under part 2 of Article 284 of the Civil Procedure Code, an application to review a default judgment may be filed within 30 days of its pronouncement.

Under part 3 of Article 284 of the Civil Procedure Code, if the full default judgment was not served on the day it was pronounced, the missed deadline may be renewed if the application is filed no later than 20 days after service of the judgment.

The calculator shows a preliminary calendar date. The court makes the final procedural assessment based on proof of service, reasons for missing the deadline, and other circumstances of the case.

Methodology

Calculation methodology

Methodology for the deadline to review a default judgment

  1. Select the scenario: 30 days from pronouncement or 20 days from service of the full default judgment.
  2. We start counting the period on the day after the relevant event.
  3. Add calendar days under the selected scenario and move a Saturday or Sunday to Monday.
  4. Renewal of the period is not automatic and depends on the evidence.
Example

Calculation example

The full default judgment was served on the defendant in Kyiv on 1 April 2026.

  • Scenario: 20 days from service
  • Service date: 01.04.2026

The estimated 20-day period ends on April 21, 2026.

The 20-day scenario is a guideline for seeking reinstatement of the time limit, not a guarantee that the court will reinstate it.

Frequently asked questions

Frequently asked questions

Which scenario should be selected by default?

If there are no special circumstances, use 30 days from the date of pronouncement as a reference. The 20-day scenario is for assessing whether to apply for renewal of the deadline.

When does the 20-day rule apply?

When the full default judgment is not served on the day it is pronounced. Filing an application within 20 days of service may then support a request to renew the deadline.

Does the calculator guarantee that the court will renew the time limit?

No. The court assesses the evidence, circumstances, and procedural conduct of the party. The calculator shows only an approximate time window.

Are public holidays taken into account?

Only Saturdays and Sundays are accounted for automatically. Public holidays and other official non-working days must be checked separately.

What to do if the time limit has already expired?

Need to promptly assess proof of service and prepare an application for review together with a motion to renew the deadline.
