Complaint against an enforcement officer

Deadline calculator for a complaint against an enforcement officer

Enter when you learned of the enforcement officer’s resolution, action, or inaction, and select the route. For Kyiv cases, do not confuse a court complaint under the Civil Procedure Code with working days under the Law on Enforcement Proceedings.

Complaint deadline calculation

Select the mode: a court complaint under the Civil Procedure Code is calculated in calendar days, while the period under Article 74 of the Law on Enforcement Proceedings is in working days.

Complaint route and type

The calculator does not determine the correct complaint route. If a court complaint under the Civil Procedure Code applies, do not rely on the longer working-day period without checking the documents.

The brief summary is easy to paste into a message to a lawyer or save for yourself.

What this calculation shows

For complaints about an enforcement officer, first determine the route. Under the Civil Procedure Code, a court complaint in a civil case has a 10-day period, or 3 days for a resolution postponing enforcement actions. Article 74 of the Law “On Enforcement Proceedings” uses 10 or 3 working days.

The calculation provides a quick calendar estimate. Before filing, identify the case number, the decision or inaction, the enforcement officer, the underlying document, and the procedural route for challenging it.

Methodology

Calculation methodology

Methodology for calculating the complaint deadline

  1. The user selects a route: a court complaint under the Civil Procedure Code or a deadline under the Law on Enforcement Proceedings.
  2. The date when the person learned or should have learned of the violation is entered.
  3. For the court route, the calculator adds calendar days and moves a deadline that falls on a weekend.
  4. For a working-day calculation, the calculator excludes Saturday and Sunday.
Example

Calculation example

The debtor in Kyiv saw an account attachment at the bank and received the enforcement officer’s order on June 8, 2026.

  • Route: court complaint under the Civil Procedure Code
  • Date it became known: 08.06.2026
  • Period: 10 calendar days

Estimated last day for a court complaint: June 18, 2026. If the selected route is indeed counted in working days, the calendar date may differ.

Separately check whether the enforcement officer’s action itself is being challenged, which procedural route applies and whether the instrument authorizing enforcement must be challenged.

Frequently asked questions

Frequently asked questions

Why does the calculator use both calendar and working days?

Because different sources set different rules. For a court complaint in a civil case, the Civil Procedure Code provides 10 or 3 days, while Article 74 of the Law “On Enforcement Proceedings” refers to 10 or 3 working days.

Is it enough to know the date the account was frozen?

Not always. The order, enforcement proceeding number, enforcement officer, and the date you learned of the infringement must be established.

Where to file a complaint against an enforcement officer?

The route depends on the document being enforced and the subject of the complaint. It may be a court under a procedural code, an administrative court, the head of a State Enforcement Service department, or another oversight body.

What to do if the time limit has already expired?

Need to assess evidence of when the violation became known and whether to request renewal or argue that the period has not yet begun.

Need to check the deadline and route for a complaint?

Submit an application if you need to identify the enforcement officer, the underlying document, the deadline, and the correct method of appeal in Kyiv.

  • the calculator result can serve as a reference for a conversation
  • documents, deadlines, or contract terms may change the conclusion
  • briefly describe the circumstances in the form if needed
