Defence filing deadline calculator

Enter the date you received the order opening proceedings and the response period set by the court. For Kyiv cases, the calculator helps track the calendar deadline, but the response itself must be prepared using the claim materials.

Estimated time limit for a response

The default is 15 days because the Civil Procedure Code requires a period that allows time to prepare a response and evidence, and that is no shorter than 15 days from service of the order.

Use the date the order and claim were actually received: postal notice, electronic cabinet, receipt, or other evidence.

The calculator does not check whether the claim was properly served, whether all attachments were received, or whether a counterclaim, evidence, motions, or an application to renew the deadline are needed.

What the calculator calculates

A statement of defense must be filed within the period set by the court. The Civil Procedure Code requires that the period be sufficient to prepare the defense and evidence and be at least 15 days from service of the order opening proceedings.

The calculator does not supply a defense position. It only helps calculate a calendar deadline based on the service date and the period stated in the ruling.

Methodology

Calculation methodology

Methodology for calculating the response deadline

  1. The user enters the date the order opening the proceedings was served.
  2. The user enters the number of days specified by the court in the order.
  3. The calculator starts counting the period on the next calendar day.
  4. The last day moves from Saturday or Sunday to Monday.
Example

Calculation example

The defendant in Kyiv received the order opening proceedings on 4 June 2026, and the court set 15 days to file a response.

  • Date the order was served: 04.06.2026
  • Deadline under the ruling: 15 days

Estimated last day to file a response: June 19, 2026.

If copies of the claim attachments were not received or the service date is disputed, the deadline and strategy may change.

Frequently asked questions

Frequently asked questions

Why must the period from the ruling be entered?

The court sets the response period in its order opening proceedings. The standard 15 days is only a baseline; read the order in the specific case.

What happens if no response is filed?

The court may decide the case on the existing record. This does not mean an automatic loss, but the defendant loses a convenient opportunity to submit objections and evidence.

Must the response be sent to the claimant?

Yes, courts usually require proof that the response and attachments were sent to the other parties. Without it, the court may leave the documents without movement or require defects to be corrected.

Can I ask for more time?

You may ask to extend or renew the time limit if there are grounds and evidence. It is advisable to prepare such a motion before the deadline expires or as soon as the obstacle becomes known.
