The debtor-status restriction applies only to ordinary debt under a written contract.

For this category, the 2026 ceiling is 100 × 3,328 = UAH 332,800.

How the preliminary check works

Article 161 of the Civil Procedure Code has a closed list of claims. This tool covers wages, alimony in statutory forms, debt for listed services and certain contractual debt against an entrepreneur or legal entity. Other claims need separate analysis.

The ceiling of 100 subsistence minimums applies only to a claim under a written or electronic contract under point 7 of Article 161 of the CPC. It is not a general ceiling for wages, alimony or debts for listed services.

The application fee is 0.1 of the working-age subsistence minimum on 1 January of the filing year. The 0.8 coefficient applies only to proper electronic filing. The exemption for alimony and wage applications depends on the statutory claim category.

Methodology

Calculation methodology

Methodology

  1. Match a single claim to a covered Article 161 category.
  2. For ordinary written-contract debt, check debtor status and the UAH 332,800 ceiling; do not apply that test to other categories.
  3. Calculate the standard rate as 0.1 × UAH 3,328 and multiply by 0.8 for electronic filing; all amounts use integer kopecks.
  4. Show the statutory exemption separately for qualifying alimony or accrued-wage applications.
  5. Keep the assessment preliminary: the court reviews documents, venue and refusal grounds.
Example

Example for Kyiv and the region

A private individual in Kyiv has a written contract and documentary evidence of UAH 120,000 owed by an entrepreneur in Brovary. They plan to file through the Electronic Court; venue must be determined under the statutory rules.

  • Contract debt: UAH 120,000
  • Debtor: entrepreneur or legal entity
  • Filing method: electronic
  • 2026 ceiling: UAH 332,800

UAH 120,000 does not exceed UAH 332,800. The standard rate is UAH 332.80 × 0.8 = UAH 266.24 estimated payable.

The example does not establish that the debt is undisputed, that jurisdiction or venue is correct, or that the court accepted the application.

Frequently asked questions

Frequently asked questions

Does every contractual debt qualify?

No. Point 7 of Article 161 of the CPC covers written or electronic contract debt of no more than 100 subsistence minimums claimed against an entrepreneur or legal entity. Certain services fall under a different provision.

Is UAH 332,800 a ceiling for alimony or wages?

No. This ceiling applies only to the contractual claim under point 7 of Article 161 of the CPC.

When is the applicant exempt from the fee?

The law exempts applicants for qualifying alimony and wage recovery claims. Verify your basis against Article 5 of the Law on Court Fees and your documents.

Will the fee be returned if the court refuses?

Under Article 164 of the Civil Procedure Code, the fee paid for a refused or cancelled order is not refunded; it can be credited toward the fee for a later lawsuit.

How should I choose the court and payment details?

Check the Civil Procedure Code's venue rules, the debtor's registered residence or location and any statutory alternatives. Obtain payment details from the specific court's official page immediately before paying.
