How to calculate and pay the court fee for a civil appeal

An appeal may be left without progress if the court fee amount or proof of payment does not meet the requirements of the case. Identify the base rate for the disputed part of the decision, calculate the payment, and check the payment details before filing.

What you should know

  • For an ordinary civil property case, the base is the fee rate payable for the original claim in respect of the disputed amount, which may differ from the amount shown on a receipt.
  • An appeal against a judgment is charged at 150% of that rate; the 2026 cap for an individual is UAH 26,624.
  • For a properly filed electronic document, a 0.8 coefficient applies to the prescribed rate.
  • Check payment details on the official page of the relevant appellate court.

When this applies

This guide is for an individual filing an appeal against a judgment in an ordinary civil property case in 2026. If the fee is calculated on the entire claim value even though only part is being appealed, the payment may be too high. If the rate is too low or proof of payment is inadequate, the court will address the deficiencies in the appeal.

First, distinguish the scope of this guide from the broader appeal process. It covers calculating and paying the fee, not preparing the appeal arguments. For filing steps and procedural deadlines, see the guide to filing a civil appeal and the appeal deadline calculator.

If the original dispute in Kyiv concerned, for example, repayment of a debt, identify exactly which part of the amount awarded or denied you are appealing. Do not copy a court address or account number from an old receipt; check the payment route separately.

What deadline or procedure applies

Article 4 of the Law of Ukraine “On Court Fee” sets the fee for an appeal against a judgment at 150% of the rate payable when the original claim was filed, within the disputed amount. The phrase “payable” matters: a receipt shows the amount actually paid, which may have been lower because of an exemption or filing method, or may have covered the whole dispute rather than only the appealed part.

If the original claim was filed earlier, use the year of the original filing when determining the base rate. Do not automatically apply the 2026 subsistence minimum to a rate from an earlier year. An example of applying a historical base appears in the Unified State Register of Court Decisions, but you should check your individual calculation against the law and the case file.

For an individual or sole proprietor appealing a judgment in an ordinary property claim in 2026, the cap is UAH 26,624. This equals eight subsistence minimums for able-bodied persons as of 1 January 2026: 8 × UAH 3,328. The official judiciary table confirms this cap. Different caps apply to special categories of rights; they are outside this guide.

For a properly filed electronic appeal, apply the coefficient 0.8 to the prescribed rate. The formula for this limited case is:

fee = min(base rate for the disputed amount × 1.5; UAH 26,624) × (0.8 for an electronic appeal or 1 for a paper appeal).

The civil appeal court fee calculator rounds to the nearest kopeck after multiplying by 1.5 and again after applying the 0.8 coefficient, using the “half up” rule. This is a technical rule for a reproducible calculation; check the amount against your case documents before paying.

How to proceed step by step

Consider a property dispute in a district court in Kyiv. An individual is appealing only the part of the decision for which the verified original-claim rate was UAH 5,000. The appeal is planned for electronic filing in 2026.

  1. Confirm that UAH 5,000 is the lawful base rate for the disputed part, rather than an arbitrary amount from a receipt.
  2. Calculate UAH 5,000 × 1.5 = UAH 7,500.
  3. Compare it with the UAH 26,624 cap; the cap does not change the result.
  4. For electronic filing: UAH 7,500 × 0.8 = UAH 6,000 approximately payable. For paper filing, the amount is UAH 7,500.
  5. Check for an exemption, identify the proper appellate court, and verify its payment details. For a case assigned to the Kyiv Court of Appeal, check its official court fee page. If another appellate court has jurisdiction, find its page through the Judiciary of Ukraine portal and confirm the details before transferring funds. Do not use an account number from this guide; it may change.
  6. Keep the proof of payment and attach it to the appeal in a way that matches the filing method.

If the base rate for the disputed part were UAH 20,000, then 150% = UAH 30,000. The UAH 26,624 cap would apply to this ordinary property category, and after applying the 0.8 coefficient the electronic payment would be UAH 21,299.20. This example does not apply to a special lower cap.

What to check before filing

Identify exactly what is being appealed: the entire judgment, a particular amount, or several independent claims. For a partial appeal, the law focuses on the disputed amount; mechanically taking a proportion of an old receipt is not always correct. If property and non-property claims are combined, this simplified formula does not apply.

Also review Article 5 of the Law “On Court Fee”: certain people and case categories may qualify for exemptions. The law also allows a party, on specified grounds, to ask the court to reduce, defer, or split the fee into instalments. This requires separate supporting documents and does not arise automatically from using a calculator.

Do not use this guide for an appeal against a procedural ruling, an appeal concerning a court payment order, an administrative or commercial case, or a dispute about social, employment, family, or housing rights, personal injury, moral damage, or division of property on divorce. The applicable rate or cap may differ. If you need to reconstruct the base for the original property claim, compare it with the claim fee calculator, keeping in mind that it is designed for a 2026 claim.

When to consult a lawyer

Legal review is especially useful when a judgment concerns several claims, only part of an amount is disputed, procedural documents were filed in different years, or an exemption is uncertain. The error most often happens before multiplying by 150%—when determining the base.

For a case from Kyiv or Kyiv Region, a lawyer can compare the original claim, judgment, and draft appeal; identify the disputed amount; check the rate for the relevant year; and review the payment documents. You can then address the deadline and method of filing separately.

Risks

Common mistakes

  • Automatically multiplying the amount on an old receipt by 1.5 without checking for an exemption, the electronic filing coefficient, or the disputed part.
  • Applying 2026 rates to an original claim filed in a different year.
  • Forgetting the fee cap or applying 0.8 to a paper appeal.
  • Sending payment to the first-instance court’s account without checking the appellate court’s page.
  • Using this procedure for an order, a court payment order, non-property claims, or special categories of dispute.

Frequently asked questions

Frequently asked questions

Is it enough to multiply the amount on an old receipt by 150%?

No. Use the rate payable for the original claim in respect of the disputed amount. The amount actually paid may have been reduced by an exemption or an electronic filing coefficient, or may have covered the entire dispute rather than only the appealed part.

What is the cap for an ordinary property appeal in 2026?

For an individual or sole proprietor, it is UAH 26,624 before applying the electronic filing coefficient. A different cap applies to certain social, employment, family, housing, and personal injury disputes; this guide does not calculate those cases.

What if only part of the amount is being appealed?

Determine the base rate for the disputed amount, not the entire original claim. If the judgment concerns several claims, their composition requires separate legal analysis.

Does the 0.8 coefficient apply when the appeal is filed electronically?

The law provides a reduced coefficient for a procedural document filed electronically. Before paying, check how the document will actually be filed and confirm the payment amount.

Where can I find the payment details?

On the Judiciary of Ukraine portal, open the relevant appellate court’s page and go to “Court Fee.” Verify the recipient, account, and payment reference immediately before paying.

Does this formula cover an appeal against a court order?

No. Separate rates apply to appeals against procedural rulings and other procedural documents. This guide covers an appeal against a judgment in an ordinary civil property case.
