Calculatorpreliminary calculation
Delay in final settlement upon dismissal
Late settlement on dismissal calculator
Enter the average daily earnings already determined under Procedure No. 100, verified working days of delay not exceeding six calendar months, and the unpaid balance of the final settlement. For a situation in Kyiv or Kyiv Region, the calculator shows an arithmetic estimate but does not decide whether the employer was at fault or whether Article 117 of the Labour Code entitles you to payment.

Preliminary calculation of average earnings and debt
The period is limited to six calendar months, not a fixed number of days. Enter working days already counted under the employee’s schedule only within that period.
Enter the ready gross figure verified under paragraphs 2–4 and 8 of Procedure No. 100.
Count these according to the employee’s schedule. Do not enter calendar days or exceed the six-month period.
Enter separately the confirmed debt for wages, unused vacation compensation and other amounts due. If already paid, enter 0.
Preliminary gross result
Based on the entered dataEstimated average earnings for the delay
137 555,00 UAH
- Unpaid settlement debt
- 28 000,00 UAH
- Total with unpaid debt
- 165 555,00 UAH
- Compensation formula
- 1 250,50 UAH × 110 workdays = 137 555,00 UAH
- General estimate formula
- 28 000,00 UAH + 137 555,00 UAH = 165 555,00 UAH
Important: This is only arithmetic. Eligibility for payment depends on employer fault, whether amounts were due and their value, and, if disputed, whether the dispute was resolved in the employee’s favor. The deciding body assesses a partial dispute and the payment amount.
The brief summary is easy to paste into a message to a lawyer or save for yourself.
How payment under Article 117 of the Labour Code is assessed
Article 116 of the Labour Code requires the employer to settle accounts on the dismissal date or, if the employee did not work that day, no later than the day after the employee demands settlement. The employer must also provide written notice of amounts accrued and paid.
Under Article 117, average earnings for the period of delay may be due if the employer is at fault and failed to pay amounts due within the periods set by Article 116, but for no more than six calendar months. This is a calendar limit on the period, not a fixed number of payable days.
When the amount due is disputed, the right depends on the outcome of the dispute. If the claims are partially granted, the body resolving the dispute determines the compensation amount. The calculator cannot replace this legal assessment.
Calculation methodology
Preliminary calculation methodology
- Use the order, notice, and payment documents to determine separately the confirmed balance of the final settlement.
- We check gross average daily earnings under paragraphs 2–4 and 8 of Procedure No. 100.
- We identify the actual delay period and cap it at six calendar months, without converting the cap into a fixed number of days.
- Use the employee’s schedule to count working days within the period already limited, then enter the resulting whole number.
- Multiply the average daily earnings by the verified working days in kopecks, and show the debt on a separate line.
- Before using the result, separately check employer fault, whether a dispute exists and its scope, the date of written notice, and the filing deadline.
Example involving a delayed final settlement
An employee of a Kyiv company was dismissed, but a confirmed final settlement of UAH 28,000 was not paid on time. Average daily gross earnings under Procedure No. 100 are UAH 1,250.50, and the already checked period, limited to no more than six calendar months, contains 110 working days under the employee’s schedule.
- Average daily earnings D: UAH 1,250.50
- Verified working days W: 110
- Unpaid balance B: UAH 28,000
Estimated average earnings: 1,250.50 × 110 = UAH 137,555. Together with the debt, the arithmetic estimate is UAH 165,555 before taxes.
The example does not prove employer fault or entitlement to the full amount. If the employer disputes all or part of the debt, the legal consequences depend on the outcome of the dispute.

Frequently asked questions
Are six months 180 working days or calendar days?
No. Article 117 sets a maximum of six calendar months. Within the actual period, working days must be counted separately according to the employee’s schedule.
Are unpaid wages added to average earnings?
These are different components of the claim. The calculator shows the confirmed debt separately, average earnings for the delay separately, and their arithmetic total so the calculation structure is clear.
Is payment automatic if the settlement is delayed?
No. The amounts due to the employee, the missed deadline, and the employer’s fault must be established. If there is a dispute, how it was resolved matters; for partial satisfaction, the deciding body determines the amount.
What is the time limit to apply to court?
For a dispute over all amounts due on dismissal, part two of Article 233 of the Labour Code provides three months from receipt of written notice of accrued and paid amounts. Delay is assessed under Article 234, which provides for valid reasons and an outer one-year limit.
What to do if written notice was not provided?
Request the notice and calculation in writing, keep proof of sending, and do not delay preparing the demand. Do not arbitrarily substitute the order date or an oral conversation for the period’s start date.
Why are older cases before July 19, 2022 treated separately?
As of this date, the versions of Articles 117, 233, and 234 of the Labour Code changed. A delay that arose earlier or spans the change requires separate analysis of the applicable versions, period, and claims already made.
