Penalty for delay in warranty repairs

Penalty calculator for delayed warranty repairs

When goods are accepted for warranty repair, the date of the repair technician’s verbal promise may not be the legally relevant date of the demand. Enter the date of the confirmed demand, the goods’ value, and the completion or inspection date: the calculator will show a preliminary amount to check against reports and agreements.

Calculate the repair delay

Use the dates in the written demand, service receipt and return certificate. A blank agreement field means the preliminary 14-day guideline applies.

The value of the goods themselves, according to the purchase document, not the repair cost.

Date you can prove that the demand was made to the seller, manufacturer, or authorized service provider.

Fill this in only if there is an agreement supported by documents. Enter the final date in this field, not the number of days.

If the repair is ongoing, use the current date in the Europe/Kyiv time zone.

Check proof of the demand, any agreement on a different deadline, and whether Civil Code rules on a final non-working day may apply. The court assesses entitlement and may reduce the penalty; delay alone does not mean an automatic refund.

The brief summary is easy to paste into a message to a lawyer or save for yourself.

How the amount is calculated

Under Article 8 of the Law “On Consumer Protection” in force on the review date, a defect must be remedied within 14 days of the demand unless the parties agreed on another period. For delay in meeting this demand, the law provides a penalty of 1% of the product’s value per day.

This is an arithmetic estimate for a claim. You must prove a proper demand, its receipt date, the product’s value, applicability of the warranty process, completion of the repair, and the absence of circumstances that change liability.

Methodology

Calculation methodology

Calculation methodology

  1. Check the goods’ price and the date the demand for warranty repair was made against the documents.
  2. Shows D + 14 as an estimated date if no other period was agreed.
  3. If a different end date has been confirmed, use it instead of the preliminary one.
  4. Count the calendar days after the selected date until actual completion or the review date.
  5. Multiply the product’s value by 1% and by the number of days; round only the final amount to the nearest kopeck.
Example

Example from Podil

The buyer submitted a defective vacuum cleaner from a Kyiv store for warranty repair and has a receipt for the written demand dated September 1, 2026.

  • Vacuum cleaner value: UAH 12,000
  • Demand date: 01.09.2026
  • No other date was agreed
  • Refund after repair: 19.09.2026

Preliminary last date — 15.09.2026. The next four calendar days give a reference amount of 12,000 × 1% × 4 = UAH 480.

For an actual instrument, check when the demand was received, whether another period was agreed, whether a non-working day affects it, and whether liability is disputed.

Frequently asked questions

Frequently asked questions

From what date should the 14 days be counted?

From the documented date a demand to remedy the defect was made, not automatically from the purchase date or from handing over an item without a recorded demand. The calculator shows a preliminary date of D + 14.

What if the receipt specifies a different deadline?

Check whether the parties truly agreed on the deadline for performing the demand. If so, enter the documented final date in a separate field.

Are weekends counted?

The preliminary calculation uses calendar days. However, Civil Code rules for a final non-working day may change the legal conclusion; automatically moving the date is unsafe.

Does the delay give an immediate right to return the product?

Delay alone is not a universal ground for an automatic refund. Other claims depend on the nature of the defect and the conditions of Article 8.

Is the displayed amount guaranteed to be recovered?

No. Evidence of the claim, time limit, value, reasons for delay, and the other party’s defenses is assessed separately; the court may reduce the penalty under the Civil Code.

Need to prepare a demand concerning delayed repair?

In Kyiv, the seller, service center, and place of delivery may have different addresses: check the legal entity named on the receipt and report so the claim reaches the responsible party. For a dispute in Kyiv or Kyiv Oblast, compare the claim date, service reports, warranty terms, and the addressee of the written complaint.

  • the calculator result can serve as a reference for a conversation
  • documents, deadlines, or contract terms may change the conclusion
  • briefly describe the circumstances in the form if needed
