Penalty for delayed service
Penalty calculator for delayed services
Did a workshop or service provider in Kyiv miss the agreed deadline? Check whether the contract specifies a separate price for the delayed work or service, and enter the confirmed calendar days of delay. The result can help prepare a written demand, but does not determine the provider’s liability.

Estimate a delay penalty
Only for a consumer agreement in which the separate price of the delayed work or service is documented.
Check the contract, estimate, or order. A package price without a breakdown is unsuitable for a daily calculation.
Preliminary calculation
First confirm from the documents whether a separate price was set for the delayed work or service.
When the 3% per day rule applies
Part five of Article 10 of Law No. 1023-XII provides for a penalty for delay in performing work or providing a service to a consumer. This calculation applies only where the price of the specific delayed work or service is determined separately.
If there is no separate price, the Supreme Court treats 3% of the total order value as a one-time charge, not 3% for each day. In this situation, the tool does not provide a monetary result.
Calculation methodology
How the result was calculated
- Check whether you ordered the work or service as a consumer and whether a special legal regime applies.
- Find a separate price for the delayed work or service in the contract, estimate, or order.
- Record the last agreed date and the number of calendar days after it until performance or the calculation date.
- Multiply the separate price by 3% and by the number of days; round only the final amount to the nearest kopeck.
- Compare the arithmetic with the evidence, exceptions, termination of the agreement, and limitation period.
Example of a Kyiv order
A consumer ordered a custom furniture module from a Kyiv workshop; its price is listed separately in the estimate. The provider finished the work after the agreed deadline.
- Price of delayed module: UAH 12,000
- 4 confirmed calendar days have passed since the last agreed date
- The contract has not been terminated during these days
Preliminary penalty: 12,000 × 3% × 4 = UAH 1,440.
Before making a demand, check the estimate, certificates, reasons for delay, and when the work was actually completed.
Documents for a claim
- Contract or order describing the work, final deadline, and contractor’s details.
- An estimate or invoice that separately states the price of the delayed work or service.
- Receipt, payment records, correspondence, and evidence of materials being provided or the consumer meeting their obligations.
- Acceptance certificate, notice of readiness or other evidence of the actual completion date.
- Written complaint with a day count and proof of service on the enforcement officer.

Frequently asked questions
Why can’t I enter the total order value?
A daily calculation requires an established separate price for the delayed work or service. If there is none, the Supreme Court’s conclusion treats 3% of the total price as a one-time charge.
What date should the count start from?
From the day after the last performance date agreed in writing. If the deadline is disputed or was agreed by the hour, check it individually.
Does a penalty accrue after the contract is terminated?
This calculator does not include that period. The consequences of ending the agreement and the scope of claims must be checked separately.
Can the tool be used for warranty repairs?
No. A different legal regime applies, with a separate penalty calculator.
Will the full amount shown be awarded?
Not necessarily. Evidence of the agreement, price, and delay is required; the court assesses the defenses and may reduce the penalty.

Need to check the claim against the enforcement officer?
For a claim in Kyiv or Kyiv Region, check who signed the order, whether a separate price is stated, when the deadline expired, and to whom the demand should be delivered.
