Repayment of a loan after demand

Loan repayment deadline calculator after demand

If the repayment date is not set in the loan receipt or agreement, or the money is repayable on demand, Article 1049 of the Civil Code of Ukraine gives the borrower 30 days from the date the demand is made. For cases in Kyiv and Kyiv Oblast, the calculator distinguishes the dispatch date from proven receipt and does not replace the specific rule with the general seven days under Article 530.

Identify the 30th day after service of the demand

Select the document type and enter the date the borrower is documented to have received the demand, not the date it was prepared or sent.

What obligation is stated in the documents?

Use the date of hand delivery against signature, confirmed postal delivery, or another method that proves receipt and content.

Is there proof of actual receipt?
Does the borrower dispute service or authenticity?

The period is tied to making the demand. Sending it without proof of actual receipt and its contents does not establish a reliable start date.

Why does the period run for 30 days rather than seven

Part one of Article 1049 of the Civil Code of Ukraine specifically governs loans: if no repayment date is set or it is tied to a demand, the borrower must repay within 30 days from the date the demand is made. Therefore, the general seven-day period under Article 530 does not replace this special rule.

Articles 253–254 set the calendar logic: the period starts the next day, and if the last day falls on a weekend, carefully check the next working day. During martial law, the calculator does not automatically treat public holidays as non-working days and does not reproduce the schedule of a particular institution.

Interest for use of a loan under Article 1048, consequences of delay under Articles 1050 and 625, and limitation periods are separate issues. Once the date is established, you can separately use the 3% annual interest calculator.

Preliminary calendar methodology

  1. We check that this is a loan with no specified repayment date or repayable on demand, rather than credit, a fixed-term loan, or an installment schedule.
  2. The baseline date is the documented date the claim was actually received; a dispute about service or authenticity stops the automatic calculation.
  3. The first day is the day after receipt, and the 30th calendar day is found by adding 30 days to the base date.
  4. A cautious extension of Saturday or Sunday to Monday is shown separately, without automatically accounting for holidays.
Example

Example of a claim received in Kyiv

The borrower in Kyiv received the demand against signature on July 10, 2026. The receipt does not state a repayment date, and service is not disputed.

  • Documented receipt date: 10 July 2026.
  • Type: loan with no specified repayment term.
  • There is a signed copy of the demand stating the amount and referring to the promissory note.

The period starts on 11 July. The 30th calendar day is Sunday, 9 August 2026; the cautious estimate is 10 August, and delay is shown from 11 August.

This is a preliminary calendar estimate. Before accruing amounts or filing a claim, check the original IOU, the contents of the demand, service, and any agreements made afterward.

  • Inventory of contents, tracking details, delivery receipt, signed copy or electronic delivery data.

Frequently asked questions

Frequently asked questions

Does mailing a registered letter start the 30 days?

Not automatically. A reliable calendar requires the date the recipient received the demand and evidence of its contents. The dispatch date alone does not prove that a specific demand was presented.

Why does the calculator not use the seven days in Article 530 of the Civil Code?

For a loan with no repayment term, Article 1049 expressly sets 30 days from the date a demand is made. This is a special rule for a loan agreement and should not be mechanically replaced with the general rule.

What to do if day 30 falls on a holiday?

The calculator does not automatically move public holidays. During martial law, non-working days are subject to a special regime, and the actual schedule may differ. Check the date before filing a claim or calculating penalties.

Can 3% per annum be calculated after this date?

The starting date for claims under Article 625 depends on the delay and the evidence. The calculator provides a calendar reference; the 3% annual interest amount must then be calculated separately and kept distinct from interest under Article 1048.

Is the calculator suitable for a loan payable in instalments?

No. The schedule creates separate due dates for installments, and Article 1050 may affect a demand for early repayment of the balance. The agreement and each overdue installment must be analyzed.

Need to check the claim and the default date?

A lawyer in Kyiv can compare the IOU, service, payment chronology and prepare a demand or claim without mixing different types of accruals.

  • the calculator result can serve as a reference for a conversation
  • documents, deadlines, or contract terms may change the conclusion
  • briefly describe the circumstances in the form if needed
