Sale of a share by a co-owner

Deadline calculator for notice of sale of a share

Before selling a share in an apartment, house, or other jointly owned property in Kyiv and Kyiv region, prove not only that notice was sent but that each co-owner actually received it. The calculator shows a preliminary period under Article 362 of the Civil Code of Ukraine and stops scenarios where simply adding days is unsafe.

The period is tied to receipt of the notice. The sending date without proof of actual receipt does not provide a reliable start date.

What exactly the calculator calculates

Article 362 of the Civil Code of Ukraine gives a co-owner the pre-emption right to buy a share at the announced price and on other equal terms. The seller must notify the other co-owners in writing. If they do not exercise the right, the period from receipt of notice is one month for real estate and ten days for movable property.

Articles 253–255 set the calendar framework: a period starts the next day, a period stated in months ends on the corresponding date, or on the last day of the month if that date does not exist. Moving the final day depends on whether that day is non-working in the specific situation, so the calculator applies only an explicit Saturday/Sunday adjustment.

A separate step-by-step guide on selling a co-owned share supplements the practical procedure for preparing a notice, evidence, and agreement.

Methodology

Calculation methodology

Preliminary calendar methodology

  1. We check that this is a sale of a specific share in jointly owned property, not another property or transaction regime.
  2. Already completed sales, changed terms, disputed or unproven receipt, and dates outside the current scope are excluded.
  3. For all recipients, use the latest proven date on which the same notice was received.
  4. Add one calendar month for real estate or ten calendar days for movable property.
  5. Only when explicitly selected: a Saturday or Sunday is conditionally moved to Monday; the earliest sale date is shown starting the following day.
Example

Example of an apartment share in Kyiv

The owner of a 1/3 share of an apartment in Pozniaky plans to sell to an outside buyer. The two other co-owners received identical written notices on 14 and 16 July 2026.

  • Common fractional ownership and sale of real estate
  • Latest confirmed receipt: 16.07.2026
  • The price, payment procedure, and other terms have not changed
  • There is no express refusal by all co-owners

The period starts on 17 July, and the nominal one-month period ends on 16 August. Without a separate adjustment, the calculator will show 17 August 2026 as the earliest sale date.

The example does not prove proper notice or review notarial documents. If the end date falls on a weekend, the rules for performing the action must be checked separately.

Documents

What to prepare before selling a share

  • Title documents and current information about registered shares and encumbrances.
  • Draft written notice stating the exact price, payment method and deadline, and other terms.
  • Separate evidence of the contents and actual receipt for each co-owner.
  • Written refusals from co-owners if the sale is planned before the full period ends.
  • Draft agreement with terms no more favorable to an outside buyer than those notified to the co-owners.
  • Documents about marriage, children’s rights, use of the property, arrests, mortgages, or other encumbrances, if they relate to the asset.

Frequently asked questions

Frequently asked questions

From what date should the month or ten days be counted?

From the co-owner’s actual receipt of written notice. If there are several addressees, use the latest proven receipt date for a cautious shared calendar.

Is it enough to state only the value of the share?

No. Article 362 requires disclosure of the price and other sale terms. The method and timing of payment, any deferral, and other material terms must match the intended transaction.

What does a co-owner’s written refusal change?

An express refusal may remove the need to wait out the full period for that co-owner. If there are several co-owners, proof of refusal from each is required; the calculator shows a cautious date after the last refusal.

Should the end date be extended if it falls on a Sunday?

Article 254 links a shift to a non-working day. The calculator does not know a particular notary’s or institution’s schedule, so it moves the date only for Saturday or Sunday and only if you explicitly select that option.

What to do if the price was reduced after notice?

Do not automatically rely on the old calendar. The co-owner must have been given an opportunity to buy on equal terms; changed terms should be assessed, and it is usually safer to notify them again.

Does the tool calculate the claim period after a sale has already taken place?

No. The one-year limitation period for a claim to have the buyer’s rights and obligations transferred depends on a separate base date and circumstances. This calculator deliberately does not determine it.
