Creditor claims against heirs

Calculator for the deadline for a creditor’s claims against heirs

If the debtor has died, the date of death alone is insufficient for the current formula under Article 1281. For cases in Kyiv and Kyiv Oblast, the calculator separately checks the date the particular heir received the certificate under Part Two, or the qualifying date when the creditor actually learned of the inheritance acceptance or certificate under Part Three.

Check applicability and the six-month period

First confirm the narrow conditions. If even one is not met, the tool will stop the automatic calculation.

Which lawful triggering event can be substantiated?

Enter a calendar date without a time; “today” and the status are determined using Europe/Kyiv.

Narrow calculation conditions

The calendar date is shown by default. The toggle checks only Saturday and Sunday, not public holidays, special working schedules, or the filing method.

Stop checkAutomatic six-month calculation is unsafe

Part three cannot be applied without proof that the creditor did not know and could not have known about acceptance of the inheritance or receipt of the certificate. Check the evidence and the route under part two.

What exactly Article 1281 calculates

Under part two of Article 1281, a creditor must present a claim to an heir no later than six months after that heir receives the certificate of inheritance.

Under part three, if the creditor did not know and could not have known about acceptance of the inheritance or receipt of the certificate, the six months run from the date the creditor actually learned of it.

This is a preclusive time limit with serious consequences for missing it, so the calculator does not replace proof of the prerequisites or apply one date to all heirs.

Methodology

Calculation methodology

Preliminary calculation methodology

  1. An earlier version of the law, a date of death without the proper trigger, and disputed awareness are excluded.
  2. Confirms one heir, a debt inherited from the deceased, and the deceased’s status as debtor.
  3. The period starts on the day after the evidenced event.
  4. Add six calendar months to the reference date, using the last-day-of-month rule.
  5. Only when explicitly selected: a Saturday or Sunday is moved to Monday; the result is compared with the current date in Europe/Kyiv.
Example

Example of a debt under a Kyiv promissory note

A creditor in Kyiv has confirmation that a specific heir of the deceased debtor received a certificate of inheritance on February 16, 2026.

  • Trigger: heir receives the certificate under part 2 of Article 1281
  • Date: 16.02.2026
  • One heir; the deceased’s debt is not personal

The six calendar months expire on August 16, 2026. This is a Sunday; if the weekend extension is applied separately, the tool will show August 17, 2026.

Before sending, check the debt amount, the demand, the heir’s address in Kyiv Region, and proof of timely delivery or filing.

Documents

What the creditor should collect

  • Contract, IOU, court decision, or another document about the deceased’s debt.
  • Death certificate and information about the opened inheritance case.
  • Proof that the specific heir accepted the inheritance or received a certificate.
  • Document showing the date the creditor received this information.
  • Calculation of the amount claimed and the deadline for performance of the principal obligation.
  • Draft written demand, enclosure inventory, receipt, and tracking information.

Frequently asked questions

Frequently asked questions

Does the six-month period automatically start on the date of death?

No. Under part two, the basis is the date the specific heir received the certificate; under part three, it is the creditor’s actual knowledge only if the creditor did not know and could not have known earlier about acceptance of the inheritance or issuance of the certificate.

Can one date be entered for several heirs?

Only if the evidence truly confirms the same event for each person. It is safer to keep a separate timeline because acceptance of the inheritance and the creditor’s awareness may differ.

What happens if the creditor missed the time limit?

Article 1281 links a missed deadline to loss of the right to claim. Before reaching a conclusion, check the proper triggering event, the version of the law, part two or three, and all evidence.

Is the last day moved from Sunday?

General calendar rules may move a non-working day. Once explicitly enabled, the tool conditionally checks only Saturday and Sunday; check public holidays and the recipient’s actual working schedule separately.

To whom and how should the demand be sent?

The recipient, content, amount, delivery method and proof of service are determined from the inheritance file and documents. Calculating a date alone does not prove that the claim was properly made.
