Acquisitive prescription
Acquisitive prescription period calculator
For real estate in Kyiv or Kyiv Region, the mere passage of ten years does not make the possessor the owner. The calculator shows only the date after which all conditions under Article 344 of the Civil Code of Ukraine can be assessed; it stops for land, contractual, unauthorized-construction, and evidentially unclear situations.

Check the calendar and basic stop conditions
Select the type of property, enter the date you began possessing it, and report the facts accurately. Dates are treated as calendar days in the Europe/Kyiv time zone.
Enter the day supported by evidence of actual possession. The calculator does not count any period before January 1, 2001.

For real estate, vehicles, and securities, the passage of time alone is not enough: a court decision is required.
Ownership of real estate subject to state registration arises upon registration, following a valid legal basis.
Important: Even if the date has arrived, the result does not mean that ownership has been acquired. For possession beginning on February 29, moving the date to the last day of February is a technical calendar assumption; check the exact end date separately. The court also assesses the nature of the property, the registered owner, heirs, good faith, openness, continuity, and all evidence.
Check the evidence and court routeWhat 10 and 5 years actually mean
Article 344 of the Civil Code of Ukraine makes acquisitive prescription depend on more than time alone. A person must take possession of another’s property in good faith and then possess real estate openly and continuously for ten years or movable property for five years.
Acquisition of real estate, vehicles, and securities on this ground requires a court decision. For real estate subject to state registration, registration also matters: the calendar does not create a registry entry automatically.
The transitional provisions of the Civil Code of Ukraine allow acquisitive prescription rules to apply to possession that began three years before the Code took effect. Therefore, the conservative baseline model does not count any period before 1 January 2001.
Calculation methodology
Calendar review methodology
- The tool first filters out land, contractual possession, unauthorized construction, and scenarios with unclear evidence.
- Then checks the asserted requirements of good faith at the time possession began, openness, and continuity.
- For the start date, use the proven date ownership began, but not earlier than January 1, 2001.
- Add 10 calendar years for real estate or 5 years for movable property to this date.
- Separately indicates whether a court decision and state registration are required; it does not determine that a right has been acquired.
Example of an apartment in Kyiv
The person claims open possession of the apartment since August 18, 2016, but must still check the initial basis for taking possession, the registered owner and heirs before applying.
- Property type: real estate, not a land plot
- Stated start: August 18, 2016
- Baseline period: 10 calendar years
The preliminary date for assessing all conditions is August 18, 2026. For an apartment, a court decision and subsequent state registration are required.
This is not a conclusion that the right has arisen: an unknown owner, valid agreement, heir, or bad faith at the outset may change the entire legal route.
What to prepare for review
- An information statement from the State Register of Rights to Immovable Property and prior title documents.
- BTI archival, inventory and technical records, technical passport and information on commissioning the property.
- Documents or correspondence explaining how possession began and why the person believed it was lawful.
- Evidence of open maintenance of the property: repairs, payments, insurance, security, photographs, and witnesses taken together, not a single receipt.
- Information about the registered owner, their death, inheritance cases, and possible heirs.
- Documents about succession, if another person’s period of possession is claimed.
- Land documents and urban-planning materials to avoid confusing rights to the building with the special land regime.

- Important

Frequently asked questions
Do I automatically become the apartment owner after 10 years?
No. Ten years passing is only one prerequisite. Real estate requires a court decision, and a right to property that must be registered arises after state registration. The court separately checks all facts and evidence.
Can years of residence under a lease be counted?
Not automatically. A lease, loan for use, safekeeping, or other permitted use confirms that the person knew the owner and the legal basis for possession. The agreement and the duty to return the property must be analyzed, not just the calendar.
Why does the calculator not calculate land?
The Land Code provides a special procedure for using a land plot. The ten-year period for real estate under Article 344 of the Civil Code of Ukraine cannot be mechanically applied to ownership of land.
Can the parents’ or previous occupant’s possession period be added?
Only if you are this person’s successor in title and can confirm the relevant legal succession. Merely living after another person does not allow deadlines to be added together automatically.
Which evidence shows open and continuous possession?
The set of evidence depends on the property: registry and technical documents, receipts, repairs, insurance, correspondence, photos, witness statements, and proof of uninterrupted possession. Paying utility bills alone does not prove that all conditions are met.
What date should be used if possession began before 2001?
In this conservative model — no earlier than January 1, 2001. The precise application of transitional provisions and the facts of the specific case should be checked before filing a claim.
