How to pay the court fee for a commercial property claim

An incorrect account or court fee amount can delay filing a property claim. Before paying, determine the value of the claim, the proper commercial court, and the actual filing method.

What you should know

  • For an ordinary commercial property claim, the rate is 1.5% of the claim value, but in 2026 it is at least UAH 3,328 and no more than UAH 1,164,800.
  • The 0.8 coefficient applies only when the procedural document is actually filed electronically.
  • The Commercial Court of Kyiv City and the Commercial Court of Kyiv Region have separate payment-detail pages; the court cannot be selected solely by the claimant’s address.

When this applies

This guide is for a legal entity filing an ordinary property claim in a commercial court of first instance in 2026. For example, a company may ask a counterparty to pay a debt under a contract. The fee depends on the claim value, while the payment details depend on the proper court. Correct arithmetic will not fix a payment sent to another court’s account.

First check whether the dispute actually falls within commercial jurisdiction under Article 20 of the Commercial Procedure Code. If the claimant is an individual in a civil dispute, use the separate civil claim fee calculator. For a contractual debt, it may also help to review evidence and the process for debt recovery and the limitation period.

What deadline or procedure applies

Under the Law of Ukraine “On Court Fee”, the rate for a property claim in a commercial court is 1.5% of the claim value, subject to a minimum of one and a maximum of 350 subsistence minimums for able-bodied persons. The 2026 Budget Law set the figure as of 1 January 2026 at UAH 3,328. The minimum is therefore UAH 3,328, and the maximum is UAH 1,164,800.

The formula for this limited case is: min(1,164,800; max(3,328; claim value × 1.5%)). If the procedural document is actually filed electronically, apply the coefficient 0.8 to the rate. Paying online for a paper claim does not by itself qualify for the coefficient.

For a quick arithmetic check, use the commercial claim fee calculator. It calculates in kopecks and rounds half a kopeck up. This is a technical convention used by the tool; verify the result before payment. Do not automatically carry 2026 rates over to 2027.

How to proceed step by step

  1. Check the claims and their value. The Commercial Procedure Code requires the claim to state its value and a reasoned calculation. Review the contract, primary documents, debt period, and each component. If the claim includes an independent non-property demand, this calculation no longer covers the entire payment.
  2. Identify the proper court. The general rule in Article 27 of the Code is tied to the defendant’s location. Articles 28–30 provide alternative and exclusive rules. In Kyiv, distinguish the Commercial Court of Kyiv City from the Commercial Court of Kyiv Region. The claimant’s location alone does not determine the account.
  3. Calculate the rate. For a claim value of UAH 500,000, the fee is UAH 7,500 (1.5%). This is between the minimum and maximum. If the claim is actually filed electronically, the approximate payment after the 0.8 coefficient is UAH 6,000; for paper filing, it is UAH 7,500.
  4. Check exceptions and pay. Before paying, check for an exemption, release from payment, or grounds to request deferral or a reduction. Immediately before payment, get the details from the official page of the proper court; do not copy an account number from an old receipt.
  5. Prepare the filing package. Attach proof of payment or proper support for an exemption, the evidence, and confirmation that copies of the claim were sent to the other participants as required by Articles 162–164 and 172 of the Commercial Procedure Code.

What to check before filing

The claim value must follow from the relief requested, not just an accounting balance. Not every dispute between companies automatically belongs in a commercial court, and not every claim against a Kyiv counterparty belongs in the Kyiv City court. Pay particular attention to territorial venue rules for real estate disputes, contracts with a special place of performance, and cases with multiple defendants.

The calculator does not cover non-property or mixed claims, court payment orders, bankruptcy, appeals, cassation, exemptions, or amendments to a claim after filing. If a payment has already been made incorrectly, or the case ended on a procedural ground that may permit a refund, separately check the procedure for refunding a court fee.

When to consult a lawyer

Legal review is useful when the amount combines principal debt, penalties, and different periods; there are multiple defendants; the dispute concerns real estate; or a request to recognize or terminate a right is added to the property claim. A lawyer can compare the wording of the claim with its value, venue rules, possible exemptions, and proof of payment.

For Kyiv and Kyiv Region, identify the proper commercial court before creating a payment instruction. If the court or the claims are identified incorrectly, recalculating the fee alone will not solve the problem.

Documents

What to prepare

  • A draft claim with a clearly stated property claim and calculation of its value.
  • The contract, invoices, acceptance certificates, correspondence, and other evidence showing how the claim arose and its amount.
  • Information about the defendant and circumstances relevant to commercial jurisdiction and territorial venue.
  • Documents supporting a possible exemption, reduction, or deferral of the fee, if grounds exist.
  • Current payment details for the proper court, a payment instruction, and proof of payment.
  • Proof that a copy of the claim and its attachments was sent to the other participants as required by the Commercial Procedure Code.
Risks

Common mistakes

  • Using the Kyiv City court’s payment details for a claim assigned to the Commercial Court of Kyiv Region, or vice versa.
  • Paying 1.5% without checking the 2026 minimum and maximum.
  • Reducing the payment by 20% when the claim is actually filed on paper.
  • Including amounts in the claim value without checking the claim’s subject and supporting documents.

Frequently asked questions

Frequently asked questions

What is the court fee for a commercial property claim in 2026?

For an ordinary first-instance claim, it is 1.5% of the claim value, but no less than UAH 3,328 and no more than UAH 1,164,800. An exemption or a court decision on payment may change the amount actually due.

Does paying online qualify for the 0.8 coefficient?

No. The law links the coefficient to filing the procedural document electronically, not to the payment method.

Which payment details apply to a dispute with a business in Kyiv Region?

First determine territorial venue under the Commercial Procedure Code. The general rule concerns the defendant’s location, but alternative and exclusive venue rules also exist. Only then open the payment page for the proper court.

Can I use this calculation to pay the fee for a mixed claim?

No. An independent non-property claim and the rules for combining claims must be assessed separately; this calculation covers one property claim.

What if the payment has already gone to a different account?

Do not file the claim treating an unchecked receipt as valid proof of payment. Ask the court and bank how to correct the payment, and separately assess whether there are grounds for a refund.
