How to Resign and Prove When Your Notice Was Received

The ordinary two-week period starts when the employer receives the notice. If you keep only unconfirmed proof of sending or fail to check the work schedule, the employment end date may be disputed. This guide sets out the steps and documents to review.

What you should know

  • For an ordinary indefinite-term contract, Article 38 of the Labour Code requires two weeks’ written notice to the employer.
  • Keep proof not only of sending, but also of the employer’s receipt of the notice and its contents.
  • The calendar estimate is receipt plus 14 days; check a non-working day against the employer’s actual schedule.
  • A valid reason, employer violation, wartime risk, or fixed-term contract requires a separate analysis.

When this is needed

This guide is for employees working under an indefinite-term employment contract who want to end their employment on their own initiative. For an employee at a Kyiv office, the practical risk often is not the wording “voluntary resignation,” but the lack of proof of when HR actually received the notice.

A separate provision, Article 39 of the Labour Code, applies to fixed-term contracts. If you need to leave earlier because of a valid reason, an employer violation, or danger during martial law, do not choose a date using the ordinary two-week calendar without checking the specific legal ground.

Applicable deadline or procedure

Under Article 38 of the Labour Code, an employee with an indefinite-term contract must give the employer two weeks’ written notice. For a preliminary calculation, use the confirmed date the notice was received: the period starts the next day, and the ordinary two weeks end after 14 calendar days. Check the calculation with the notice period calculator.

For example, a Kyiv company accepted a notice with an incoming stamp on Tuesday, 6 October 2026. The count starts on 7 October, and the two-week estimate falls on Tuesday, 20 October. This does not guarantee that the order will use that exact date: check the notice, work schedule, and circumstances between filing and dismissal.

Article 241-1 of the Labour Code requires the nearest working day to be considered if the period ends on a non-working day. Saturday or Sunday is not necessarily a non-working day for a particular employer, so automatically moving the date to Monday is incorrect.

Steps to take

  1. Identify the contract type. For a fixed-term contract, do not use the ordinary Article 38 procedure without checking Article 39.
  2. Prepare a written notice. State the ground, requested date, signature, and date of writing. If requesting a different period because of a valid reason or an employer violation, explain it specifically.
  3. Deliver it to an authorized person. Ask for an incoming stamp on your copy. If mailing it, keep the notice, inventory of enclosed items, and delivery confirmation.
  4. Record the delivery date. This is the date needed for the calendar; the sending date does not prove receipt.
  5. Compare the calendar with the schedule. Add 14 days, then check whether the estimate is a working day for the employer.
  6. Check the order and payments. Verify the ground and date in the dismissal order, the final pay statement, and compensation for unused leave.

What to check before filing

If an inability to continue working or an employer violation supports an earlier date, gather evidence before submitting the notice. During martial law, Article 4 of Law No. 2136-IX concerns hostilities near the workplace and a threat to life or health, but it contains exceptions for employees engaged in socially useful work or work at critical infrastructure facilities. Assess the specific circumstances rather than assuming the two-week period is generally shortened.

If you change your mind, notify the employer in writing. Article 38 of the Labour Code also addresses what happens when an employee does not leave after the period ends and no longer requires termination; a separate exception applies to an invited replacement whom the employer cannot lawfully refuse to hire.

When to consult a lawyer

A review is useful if the employer denies receiving the notice, does not issue an order, sets a different date based on an unclear schedule, or disputes the ground for earlier dismissal. A lawyer in Kyiv can compare copies of the notice, postal records, the work schedule, and HR documents.

If the dismissal date has passed and final pay is delayed, that is a separate route: how to claim average earnings for delayed final pay. Keep a dispute over the notice date separate from checking the amount and timing of payment.

Documents

What to prepare

  • The employment contract and HR records showing whether it is indefinite-term or fixed-term.
  • A copy of the notice stating the grounds, requested date, and employee’s signature.
  • A copy bearing an incoming stamp or postal evidence of the notice’s contents and delivery to the employer.
  • The employer’s work schedule for the date the two weeks end and correspondence about an agreed date.
  • The dismissal order, final pay statement, and information about unused leave.
Risks

Common mistakes

  • Counting two weeks from the date the notice was written or sent without proof it was received.
  • Automatically moving a Saturday or Sunday without knowing the employer’s actual schedule.
  • Treating the calendar estimate as a guaranteed dismissal date and failing to check the order.
  • Applying Article 38 to a fixed-term contract or a special ground for an earlier date.

Frequently asked questions

Frequently asked questions

When do I start counting the two weeks?

From the confirmed date the employer received the notice: the period starts on the next calendar day. If you only know the sending date, first establish and keep proof of delivery.

Can I send the notice by mail?

Yes. Keep a copy of the notice, an inventory of enclosed items, and a delivery confirmation or other proof connecting the delivered letter to the notice’s contents. Receipt by the employer is what matters for the timeline.

What if the fourteenth day is a non-working day?

Check the employer’s actual schedule. Article 241-1 of the Labour Code ties the end of the period to the nearest working day when the last day is non-working. The weekday alone is not enough.

Does a valid reason allow me to leave earlier?

Article 38 allows termination on the date requested by the employee where the law recognizes an inability to continue working or an employer violation. State the reason and date and check the supporting evidence separately.

What changes during martial law?

Article 4 of Law No. 2136-IX allows a different period when hostilities occur near the workplace and the employee’s life or health is at risk, but it provides exceptions for certain work. It is not a general right to leave on the day notice is given.
